  • Farm Bill 2018: Hemp is No Longer a Controlled Substance

    During most of the last century, we had to import all of our hemp. It was illegal to grow in the U.S. because it was mistakenly classified as a controlled substance. But hemp is not marijuana. Hemp cannot get you high. In 2018 the Farm Bill Act passed Congress the era of prohibition will soon be over. Hemp and hemp derivatives are now permanently removed from regulation under the Controlled Substances Act! 

    Hemp is now permanently removed from the Controlled Substances Act (CSA). It is forever deemed an agricultural commodity, no longer mistaken as a controlled substance, like marijuana.

    What about my CBD oil does the Farm Bill 2018 clarify its legality? 

    There is much celebration on the passage of the Farm Bill does this mean all the confusion about CBD oil is over? Unfortunately – NO! The Farm Bill provides that the states CAN BE more restrictive than the Federal Government. 
    They can NOT however restrict the transportation of hemp and hemp derived products through the state.

    Prior to the passage of the Farm Bill that clearly removed hemp from the controlled substance act, the owner of a store in Pocatello was under investigation for selling hemp derived CBD oil in her shop. The police confiscated the oil without a search warrant and tested it in their labs. They claim the oil contained THC and is therefore is considered a controlled substance and illegal in Idaho. According to testimony at the legislative hearings early 2018, Idaho doesn’t have a testing facility that can detect THC in the minute quantities that are found in the hemp derived CBD oil sold in retail stores throughout the state.

    While the owner wasn’t arrested, the police issued a warning to all residents of the city “anyone possessing or selling CBD oil can result in criminal charges.” According to the local news station police said under Idaho law, the presence of THC, in any amount, is illegal to sell, possess, or consume. They say it is the police department’s policy to actively investigate reports of illegal activity and pursue criminal charges when warranted, including businesses or individuals who may have purchased illegal products.

    Hemp is removed from the definition of “marijuana,” and THC found in hemp is excluded from the definition of a controlled substance. 
    …and popular products such as hemp-derived cannabidiol (CBD) can no longer be mistaken as controlled substances, like marijuana.

    By redefining hemp to include its “extracts, cannabinoids and derivatives,” Congress explicitly has removed popular hemp products — such as hemp-derived cannabidiol (CBD) — from the purview of the CSA. Accordingly, the Drug Enforcement Administration no longer has any possible claim to interfere with the interstate commerce of hemp products. This should give comfort to federally regulated institutions — banks, merchant services, credit card companies, e-commerce sites and advertising platforms — to conduct commerce with the hemp and hemp product industry.

    Johnathan Miller goes on to state:

    The FDA continues to exercise jurisdiction over the regulation of ingestible and topical hemp products. 
    We applaud the agency’s continued efforts to crack down on bad actors who undermine the industry through misguided marketing claims. And while we are concerned about non-binding statements made by the FDA that have led some state and local officials to question the legality of the retail sale of hemp-derived CBD, we are hopeful that we can work with the agency to clarify that CBD – which <FDA’s> own scientists concluded has no abuse potential and does not pose a risk to public health – should not be withheld from Americans who count on it for their health and wellness.

    Economic analysts predict hemp foods and pharmaceuticals to emerge as a multi-billion U.S. market by 2020. The most popular product – hemp-derived cannabidiol or CBD – has been declared by the World Health Organization’s Expert Committee on Drug Dependence as safe and well-tolerated in humans (and animals), and is not linked with any negative public health concerns. Furthermore, the WHO concluded that CBD does not induce physical dependence and is not associated with abuse potential.

    Legalization How Much Potential Change?

    The era of hemp prohibition is over.  Effective immediately, hemp is permanently deemed a legal agricultural commodity, and popular products such as hemp-derived cannabidiol (CBD) can no longer be mistaken as controlled substances, like marijuana. The Drug Enforcement Administration now has no possible claim to interfere with the interstate commerce of hemp products. This should give comfort to federally regulated institutions — banks, merchant services, credit card companies, e-commerce sites and advertising platforms — to engage in commerce with the hemp and hemp product industry.  An exciting, emerging, multi-billion-dollar hemp industry is now unleashed, providing economic opportunity to farmers and small businesses all across America.

    Passage of Farm Bill – can farmers plant acres of hemp now?

    There will be much regulation regarding the growing of hemp, time will tell if the industry will grow beyond the medicinal resources of CBD oil. However, leading farm groups like the American Farm Bureau Federation and the National Farmers Union are calling for passage of bi-partisan House and Senate bills that remove hemp from the Controlled Substances Act, empower state agriculture programs, and unleash an exciting new industry.Hemp Legalization is around the corner as the US Farm Bill 2018 was passed in both the House and the Senate and was signed by the President on December 20, 2018.

    Hemp farmers now can fully participate in USDA programs for certification and competitive grants, crop insurance and the legal transportation of plants and product.

    • Section 297B (a)-(d) (p. 429) Empowers states and Tribes to submit plans to USDA to implement a permanent hemp growing program
    • Section 10114 (p. 435): Nothing in the act prohibits the interstate commerce of hemp, nor can States or Tribes prohibit the transportation of hemp or hemp products through their territory.
    • Title XI (p. 439): Hemp farmers are made eligible for crop insurance, and marketability requirements for the crop insurance program can be waived.

    Other Benefits of Hemp Cultivation textiles, food, biodegradable plastic, fuel, paper and medicines. 

    Best known historically for its use to make paper and rope (neither of which are often made with hemp these days, because there are better materials), the crop’s versatility is its major selling point. It’s used in the manufacture of fabrics, household products, fuels, plastics, construction materials, and all kinds of other stuff. It has gained some popularity as a food ingredient in recent years. The U.S. Department of Agriculture has said that “the market potential for hemp seed as a food ingredient is unknown. However, it probably will remain a small market, like those for sesame and poppy seeds.” The total retail market for hemp in the United States is only about $500 million. That will no doubt grow with domestic cultivation — and perhaps with innovations in manufacturing technologies that could increase demand.

    The question remain will Idaho continue restricting the sale of CBD oil in retail locales?
    Will legislators see the potential for hemp based fuel, fiber and food that the hemp industry could create for local economy and propose legislation that will encourage growth in this untapped market?

  • Bees Attracted to Dangerous Fungicides

    Most people have heard that honey bee populations are struggling–and the affects that neonicotinoid pesticides are having on honey bee health are gradually becoming main-stream knowledge. Interestingly, what is coming to light as more research is done, fungicides may also have an adverse effect on honey bee health as well.

    We need bees. With 80% of food crops relying on honey bees for pollination, it has been found that one of every three bites of food we eat is pollinated by bees. Declines in honey bee populations have caused global concern for the world’s food supply and the uncertain future that would bring.

    This excerpt from an article in Science Daily details the findings of honey bees and fungicides.

    When given the choice, honey bee foragers prefer to collect sugar syrup laced with the fungicide chlorothalonil over sugar syrup alone, researchers report in the journal Scientific Reports.

    The puzzling finding comes on the heels of other studies linking fungicides to declines in honey bee and wild bee populations. One recent study, for example, found parallels between the use of chlorothalonil and the presence of Nosema bombi, a fungal parasite, in bumble bees. Greater chlorothalonil use also was linked to range contractions in four declining bumble bee species.

    To test whether foraging honey bees showed a preference for other chemicals they are likely to encounter in the wild, researchers set up two feeding stations in a large enclosure. Foraging honey bees could fly freely from one feeder to the other, choosing to collect either sugar syrup laced with a test chemical or sugar syrup mixed with a solvent as the control. Over the course of the study, they tested honey bee responses to nine naturally occurring chemicals, three fungicides and two herbicides at various concentrations.

    The trials revealed that honey bees prefer the naturally occurring chemical quercetin over controls at all concentrations tested.

    To the researchers’ surprise, the bees also preferred sugar syrup laced with glyphosate — the active ingredient in Monsanto’s Roundup herbicide — at 10 parts per billion, but not at higher concentrations.

    “The bees are not only not avoiding this fungicide, they’re consuming more of it at certain concentrations,” Berenbaum, the team’s research leader, said.

    Fungicides are among the most prevalent contaminants of honey bee hives, and it is likely the bees themselves are bringing these pesticides into the colony through their food-collecting activities. While perplexing, bees’ preferences for some potentially toxic chemicals may be the result of their distinct evolutionary history, Berenbaum said.

    The new findings are worrisome in light of research showing that exposure to fungicides interferes with honey bees’ ability to metabolize medications used by beekeepers to kill the parasitic varroa mites that infest their hives.

  • Toxic Plastic Food Storage

    Are your food containers dangerous to your health? Many chemical additives that give plastic products desirable performance properties also have negative environmental and human health effects.
    These effects include

    • Direct toxicity, as in the cases of lead, cadmium, and mercury
    • Carcinogens, as in the case of diethylhexyl phthalate (DEHP)
    • Endocrine disruption, which can lead to cancers, birth defects, immune system suppression and developmental problems in children. 

    In the news just this week,a report ranked Whole Foods the worst of five major grocery chains when it comes to chemicals found in food packaging. The studies found high levels of Fluorine in five of the 17 items tested at the store, four of which were containers for its salad and hot food bar. The company responded by removing all the coated paper products in question and is in search of a biodegradable replacement. This report should make us all pause and think about the toxicity of food containers in our own homes. 

    The reality is that plenty of products in grocery stores—and your kitchen cabinets—may still be leaching toxic chemicals into your food and drinks. 

    Hazardous Food Storage 

    1. Polyethylene terephthalate (PET or PETE)
    Polyethylene terephthalate (PET or PETE) is one of the most common types of plastic and is commonly found in bottles of soda, juice, water and cough syrup and jars of peanut butter. The bottoms of these containers are usually stamped with the chasing arrows symbol and the number 1, the code for PET.

    Other sources include: Water and soda bottles, carpet fiber, chewing gum, coffee stirrers, drinking glasses, food containers and wrappers, heat-sealed plastic packaging, kitchenware, plastic bags, squeeze bottles, toys. 

    HEALTH CONCERNS: Suspected Human Carcinogen

    3. Polyvinyl chloride (PVC)
    Polyvinyl chloride, or No. 3 PVC, is found in shower curtains, meat and cheese wrappers, ring binders, some bottles, plumbing pipes and building materials. Commonly called vinyl, PVC and closely related PVDC differ from other vinyls, which lack the toxic chloride. PVC continues to be used in many toys.

    HEALTH CONCERNS: Can cause cancer, birth defects, genetic changes, chronic bronchitis, ulcers, skin diseases, deafness, vision failure, indigestion, and liver dysfunction

    6. Polystyrene, or Styrofoam
    Polystyrene, also known as Styrofoam, is used in disposable cups and take-out food containers, packing peanuts, trays and egg cartons. Most fast-food chains, including McDonald’s, phased out polystyrene for sandwich containers more than 20 years ago. 

    Many food containers for meats, fish, cheeses, yogurt, foam and clear clamshell containers, foam and rigid plates, clear bakery containers, packaging “peanuts”, foam packaging, audio cassette housings, CD cases, disposable cutlery, building insulation, flotation devices, ice buckets, wall tile, paints, serving trays, throw-away hot drink cups, toys

    HEALTH CONCERNS: Can irritate eyes, nose and throat and can cause dizziness and unconsciousness. Migrates into food and stores in body fat. Elevated rates of lymphatic and hematopoietic cancers for workers.

    PFAS/PFCs

    Per- and polyfluoroalkyl substances (PFASs, also sometimes called PFCs) are synthetic chemicals that are used in a number of products to make them more grease, stain, and water-resistant. These substances, also called fluorinated chemicals, are found in grease-resistant food packaging, or fast-food wrappers, pizza boxes, and microwave popcorn bags.

    In a test of more than 400 fast-food wrappers, paperboard containers, and beverage containers, researchers found that almost half—46 percent—of the fast-food wrappers and papers and 20 percent of paperboard samples contained detectable amounts of these chemicals.

    PFASs are highly stable and highly persistent, which means they linger and don’t break down with heat or cold. They can also accumulate in the body. What’s more concerning is the many places in which you can come into contact with the chemicals. They are also found in carpet, waterproof apparel, non-stick cookware, and more.

    HEALTH CONCERNS: PFASs are associated with cancer, thyroid disease, and developmental problems, in addition to other health issues

    Phthalates

    Phthalates are a type of plasticizer added to plastics ingredients to make them soft and flexible. They are part of a group of plastics called polyvinyl chloride (PVC). They’re found in plastic wraps and some commercial food containers. They’re especially prominent in commercial plastic wraps.

    Phthalates can leach into foods that come into contact with the plastics. Fatty and oily foods are especially efficient at wicking the chemicals from food, and heating the plastic increases the rate at which the chemicals can transfer.

    HEALTH CONCERNS: Research is very limited, some studies suggest phthalates may lead to early onset of puberty, reproductive defects, lower sperm count, and other health issues. The effects are most troublesome for children, because their smaller bodies have a higher rate of exposure to the chemicals than larger adult bodies.

    7. Polycarbonate, with Bisphenol A BPA (#7)

    BPA is now widely known toxin in recent years. EWG reported in an article in February 2018 of the damaging effects of BPA on people. The Centers for Disease Control and Prevention found BPA in the urine of more than 90 percent of Americans sampled. In 2009, tests commissioned by EWG were the first to find BPA in the umbilical cords of nine of 10 infants sampled.

    Because food packaging is the primary source of exposure, it stands to reason that BPA levels in our bodies are affected by what we eat and how that food is packaged. Even “microwave safe” plastics can leach BPA. Some migrate more of the chemicals into food when the plastics are heated, washed in the dishwasher, or cut/scratched, like what can occur when you use a fork or knife in the container.

    BPA, a type of polycarbonate, is a major ingredient in many plastics and can liners and was used widely in baby bottles and sippy cups for decades. In 2012, the U.S. Food and Drug Administration (FDA) banned the use of BPA in baby bottles, citing potential harm to the brains and reproductive development of infants and children.

    Researchers have known for decades, since 1936, that BPA mimics estrogens and binds with the same receptors as the hormone throughout the human body. The exposure to the chemicals has been associated with increased breast cancer risk, obesity, and reproductive abnormalities, in addition to other health effects. Still, the chemicals have been used widely since the 1950s.

    HEALTH CONCERNS:

    BPA acts like estrogen in the body. It disrupts hormones, affects brain development and metabolism, and harms the reproductive system. Evidence suggests the developing fetus and young child are most at risk, but adolescents also appear uniquely vulnerable. BPA has also been linked to cancer, heart disease and other serious disorders.

    Scientists  have linked very low doses of bisphenol A exposure to cancers, impaired  immune function, early onset of puberty, obesity, diabetes, and  hyperactivity, among other problems (Environment California)

    EWG continues in their article some startling concerns. 

    In 2016, EWG created a database of about 16,000 processed foods and drinks that might be packaged in materials that contain BPA. In California, products packaged in materials with BPA must carry a warning label on the package or store shelves.

    As the food industry scrambles to find alternatives to BPA, concern has grown that without appropriate oversight, food companies will substitute similar chemicals or new chemicals that could be just as harmful or even more harmful. A National Toxicology Program study of 24 replacement chemicals found that many already in use are structurally and functionally similar to BPA, and, just like BPA, may harm the endocrine system.

    BPS is an endocrine disruptor that mimics hormones and blocks the action of other hormones. In short, it’s almost the same bad chemical with the same toxic results.

    5 Steps to reducing BPA and potentially reducing other plastic toxins:

    1. Substitute fresh, frozen or dried food for canned.
    2. Limit how many packaged foods you eat.
    3. For those who cannot avoid foods in BPA-lined cans, rinsing the food in water may help lower the level of BPA in the food. Bonus: Rinsing cuts back on other additives too, such as sodium on beans or sweet syrup on fruit.
    4. Never heat food in the can. Transfer it to a stainless steel pot or pan for stovetop cooking, or microwave in glass – not plastic.
    5. Search for your family’s favorite foods and beverages in EWG’s BPA product list. If they are packaged in containers made with BPA, look for alternative products in EWG’s Food Scores. Tip: Use the BPA-free filter function when searching.

  • Dirty Genes in Vaccines

    Prior to vaccination your risk of dying from these infections was still less than your risk of dying from a lightning strike, choking, or falling in the shower. It was uncommon for a child to experience an adverse outcome from these infections. Just like it is uncommon for a child to experience an adverse outcome with vaccination, perhaps we have exchanged one genetically susceptible child with another?

    What happens when our government regulatory agencies tasked with protecting the public’s health fails to disclose the risks known by the industry? In the case of viruses and DNA in vaccines, the FDA has internally noted that “small amounts of residual cell substrate DNA unavoidably occur in all viral vaccines as well as other biologics produced using cell substrates.

    There are several potential ways DNA could be a risk factor. DNA can be oncogenic or infectious; in addition, it can cause insertion mutagenesis through integration into the host genome.”Since all vaccines contain residual DNA that has a potential to be oncogenic (causing cancer), mutagenic (changing your genetic code), and infectious, isn’t it of major concern that section 13 of every vaccine package insert states that the product has not been evaluated for carcinogenic (causing cancer) or mutagenic effects?

    The FDA continues: “The use of human tumor-derived cell lines poses added safety concerns regarding the potential presence of unexpected and unknown viruses. These include viruses that may be present in the cell line due to their existence in the patient tissue such as oncogenic, latent DNA viruses (e.g., adenovirus, hepadenoviruses, herpesviruses, papillomaviruses, polyomaviruses) and endogenous retroviruses (ERVs), which exist normally in a quiescent state in the host cell DNA of all species…”

    This suggests that these viruses are sleeping and inactive, currently not expressing, and have the full potential to cause infection if they are woken from this sleep. These quiet and sleeping viruses can only be detected in the cells used to make vaccines if they are activated making their presence; and then their detection is quite problematic. This is an issue for all cell strains used to make vaccines and is not unique to human tumorigenic cells.

    Genetic engineer Dr. Theresa Deisher, a PhD in Molecular and Cellular Physiology from Stanford University with over 20 years experience in biotechnology, reports that 

    “not only damaged human cells, but also healthy human cells can take up foreign DNA spontaneously. Foreign human DNA taken up by human cells will be transported into nuclei and be integrated into host genome, which will cause phenotype change.”

    So here we have proof that the human DNA in the following vaccines has the potential to cause genetic changes in every child who receives them:

    1. Measles, Mumps, Rubella vaccine/MMR
    2. Diphtheria, Tetanus, Pertussis, Poliomyelitis vaccine (DTaP/TdP)
    3. Varicella (Chickenpox) Vaccine & Shingles (zoster) vaccine
    4. Hepatitis A vaccine
    5. Rabies vaccine
    6. Polio vaccine
    7. Haemophilus influenzae

    According the Advisory Committee on Immunization Practices (ACIP) and depending on the products used, a child has the potential to receive up to six separate injections that contain residual human DNA by the time they are 2 years old.

    The FDA goes on to discuss the safety aspect of residual DNA in vaccines: Dr. Peden, Chief of the Laboratory of DNA Viruses at the FDA, states that “it depends on the mechanism of transformation. For example, mutations, chromosome rearrangements, translocations, retrotranspositions, etc., all involve DNA.  Therefore, reducing the size and amount of the DNA should mitigate this risk” (bold emphasis added).The conclusion that DNA size will reduce the risk of mutagenesis and infection is based on nothing more than a belief. Research shows us that in mammals, such as humans, the genetic code is highly repetitive, meaning it is homologous (similar in structure). 

    Small fragments of DNA are used to achieve genetic modification in a therapeutic manner. It is not much of a stretch to assume this same observation occurs in a non-therapeutic manner as well:

     “Homologous Replacement is used to modify specific gene sequences of chromosomal DNA in a process referred to as ‘Small Fragment Homologous Replacement’, where DNA fragments replace genomic target resulting in specific sequence changes.”

    Studies show that it is a matter of an individual’s genetics that increases their risk and susceptibility to the infectious nature of DNA and insertion mutagenesis (bold emphasis added):“Residual DNA (rDNA) is comprised of deoxyribonucleic acid (DNA) fragments and longer length molecules originating from the host organism that may be present in samples from recombinant biological processes. Although similar in basic structural base pair units, rDNA may exist in different sizes and physical forms. Interest in measuring rDNA in recombinant products is based primarily on demonstration of effective purification during manufacturing, but also on some hypothetical concerns that, in rare cases, depending on the host expression system, some DNA sequences may be potentially infectious or oncogenic (e.g., HIV virus and the Ras oncogene, respectively).”Dr. Peden goes on to say that in primary cells and diploid cells there are no limits for the amount of DNA in vaccines”. That means these safety measures to limit the amount of residual DNA does not apply to live virus vaccines grown in human diploid cells such as the MMR and varicella.

    In addition to the abomination of genetically modifying our children through insertion mutagenesis of male and female human diploid cell strain DNA without disclosure, is the other elephant in the room: the presence of human endogenous retrovirus K (HERV-K) that was found in MMRII and VARIVAX. It is important to note it was the WI-38 and MRC-5 cell strains that contain this contaminant and as such, any and all products used with these cell lines will contain HERV-K.

    Human endogenous retrovirus (HERV) is associated with a myriad of chronic disease states:

    “Several mechanisms by which HERVs could produce pathological effects have been proposed, including generation of new variants of HERVs, insertional mutagenesis, and protein toxicity. In this regard, HERV activation appears to influence the aggressiveness of different cancers, including seminoma, melanoma, leukemia, hepatocellular carcinoma, sarcoma, prostate, breast and colon cancer. Likewise, the pathologic process of rheumatic disorders, systemic lupus erythematosus, multiple sclerosis, autism spectrum disorders, schizophrenia, bipolar disorder, psoriasis, type I diabetes, and systemic sclerosis shows a correlation with HERV activity.” 

    Childhood cancers are on the rise and we cannot underestimate the role directly injecting HERV-K has on this observation. Especially when it is directly associated with leukemia as can be seen here: “In patients with leukemia, the presence of antibodies against HERV-K has been identified, which could suggest increased expression of HERV-K in leukemic cells.”

    And here:

    “Antibody response against HERV-K peptides has been reported in leukemia patients, suggesting a possible over-expression of this sequence in leukemic cells.”

    Here we see that herpesviruses are shown to reactivate HERV, “Herpesviruses may also be a significant trigger of HERV expression in the CNS. Multiple reports have detected EBV, herpes simplex virus type 1 (HSV-1), varicella-zoster virus (VZV), and human herpesvirus type 6 (HHV-6) in MS patient samples; all these herpesviruses have also been demonstrated to trigger the expression of HERVs.” 

    It should be highly concerning to all that we find HERV-K in the presence of a live herpesvirus, as is the case with VARIVAX (varicella-zoster).  

    Given the above information, it seems that all vaccines are inherently dangerous and each individual, not a government agency, should be making their own risk-to-benefit analysis for using these products. It also means that we are all participating in an experiment to which we did not consent and from which we are still learning about the unintended consequences of consuming such products. It is not a secret — although rarely discussed by various media 

    outlets and medical professionals we entrust with our children — that the infections we have vaccines for were acute, self-limited, common, childhood infections, as can be seen here in this very well-researched article.

    Dr. James Lyons-Weiler said it best

    “If we as a society enjoy collective benefit from protection from infectious diseases due to vaccines, then we as a society share the collective responsibility to protect those who are the greatest risk of harm from vaccines. Enough with the propaganda that says there is no risk; enough. Genetics and careful attention to reliable risk factors will play a fundamental role in protecting those among us who are most susceptible…”.

  • Healthcare Employee: Your Right to Vaccine Exemption

    Hundreds of healthcare workers requested information about the discrimination they are facing in the workplace due to mandated vaccinations. These individuals are being terminated from employment over a medical procedure that violates their conscience or moral belief. 

    The very unfortunate reality is that our health freedoms are under attack in our country. The choice to be vaccinated or not as an adult should be a private decision, but now our vaccination status has become a condition for employment at many hospitals.

    Those who fight for a religious or medical exemption are often denied due to strict interpretations by hospital policy administrators. The assistance of a vaccine lawyer is often required to successfully utilize exemptions that hospital policies will allow. Placing dedicated hospital employees in the difficult position as of either submitting to a dangerous medical procedure or face being fired is unethical and unfair.

    While the federal government cannot restrict or enforce vaccine mandates they can protect individuals facing discrimination by their employers. 

    In January 2018, the current administration established division of the Department of Health and Human Services (HHS) that was designed “to restore federal enforcement of our nation’s laws that protect the fundamental and unalienable rights of conscience and religious freedom” and specifically provides oversight to those organizations that receive federal funding.     “Conscience protections apply to health care providers who refuse to perform, accommodate, or assist with certain health care services on religious or moral grounds.”

    In addition, the Federal Government offers protection from religious discrimination to employees under the Equal Employment Opportunity Commission (EEOC).

    In an effort to support our healthcare employees, Health Freedom Idaho hosted an educational seminar with attorneys Alan Phillips J.D. and Colton Boyles to help support the healthcare community by providing information about civil rights and the process to file complaints with the proper authorities when those rights are violated.

    Three Steps to Preserving Your Civil Rights

    1. START – With Hospital/Administration Policy Makers

    There are steps you need to take prior to termination in order to protect yourself. Start by submitting an attorney drafted letter requesting religious accommodation for vaccine exemption and providing the hospital/entity with information regarding their civil rights violations. It is easier to attempt to change your hospital/employers internal policy towards protecting the civil rights of employees and ultimately affecting you and your co-workers in a positive manner.

    2. NEXT – File With the New HHS Department

    What is the consequence to the employer who participates in moral/religious discrimination?

    An entity receiving federal funding through HHS has the potential of losing the federal funding if they violate an individual’s right for religious or moral conscience. This could be an opening to ensure that all vaccine coercion at a state level is stopped from a federal level.  Alan Phillips J.D. said that it appears that the rules updated November 2018 do NOT EXCLUDE vaccinations.

    Christiana Hilderbrand of a Voice for Choice Advocacy shared earlier this year that the new Conscience and Religious Department of the HHS might afford an opportunity for employees to be heard on matters of religious discrimination from ‘immunization policies’ in the workplace for those organizations/employers receiving HHS funding. (See her video here).

    Kent Heckenlively, JD commented on the new HHS Department with encouraging words: 

    “The lawyer in me recognizes expansive legal language and my little litigator’s heart rejoices with the arguments I can spin from it.” 2

    How can you know if your employer is receiving federal funds?

    There are very few organizations that do NOT receive federal funding from of one of the numerous programs offered by HHS.

    Has your conscience or religious freedom been violated?

    Complaints filed earlier this year are currently being reviewed. It is critical for those who have experienced discrimination to file a complaint.

    HHS Office for Civil Rights, Director Roger Severino said,

    “Law protecting religious freedom and conscience rights are just empty words on paper if they aren’t enforced.  No one should be forced to choose between helping sick people and living by one’s deepest moral or religious convictions, and the new division will help guarantee that victims of unlawful discrimination find justice.  For too long, governments big and small have treated conscience claims with hostility instead of protection, but change is coming and it begins here and now.”

    How do I file a complaint?

    The process is rather straightforward. Gather specific information, names, dates about the situation and fill out the online form. 

    How Long Does The Process Take?

    Many have filed complaints, but few have heard a response back. Some individuals have indicated that they received word back that their complaints have been received by the HHS with an investigation pending.     Is Filing With HHS the Only Course Of Action? No, Says Alan Phillips J.D.

    Alan Phillips, the nation’s leading vaccine rights attorney, speaks with authority about vaccine exemptions in the workplace. He started the event reminding us that if you speak out against corruption, you risk being attacked. If you stay silent, it is certain we will all be attacked.

    Alan shared his expertise with the audience regarding vaccine exemption discrimination in the workplace.

    So How Do We ‘Stand Together’?

    Mr. Phillips feels that the HHS may not be the most productive place to file a complaint as an employee. As a new department, it doesn’t seem to follow it’s internal rules and may be inconsistent in how they approach cases. He filed two complaints with the department and hasn’t heard back on either. However he explained further, 

    “The worst thing that could happen if you file a complaint of employment discrimination with the HHS is you will receive a letter back saying ‘we can’t help you.’

    3. File A Complaint With the EEOC: The Best Opportunity To Be Heard 

    The Federal Department that has long handled discrimination cases is the Equal Employment Opportunity Commission (EEOC). 

    • To preserve the ability of EEOC to act on your behalf and to protect your right to file a private lawsuit, you should contact EEOC promptly when discrimination is suspected: The U.S. Equal Employment Opportunity Commission (EEOC), 1-800-669-4000 (toll-free) or 1-800-669-6820 (toll-free TTY number for individuals with hearing impairments) or go to www.eeoc.gov.

    Colton Boyles, associate with the Davillier Law Group in Sandpoint, Idaho, provided information about religious discrimination in the workplace by reading from the EEOC compliance manual found on their website:

    “Title VII of the Civil Rights Act of 1964 prohibits employers from discriminating against individuals because of their religion (or lack of religious belief) in hiring, firing, or any other terms and conditions of employment. The EEOC definition of ‘religion’ typically concerns ultimate ideas about life, purpose, and death.”

    A recent case of religious vaccine exemption denial and how the EEOC and DOJ both got involved.  

    Ms. Williams was terminated from employment at a nursing home that mandated flu shots because her employer refused her request for religious exemption. On October 24, 2016, Williams met with Campus Administrator Ralph Luedtke, the Center’s highest-ranking official, and requested a religious exemption from its mandatory vaccination policy. In their meeting, Williams explained that she had a religious belief stemming from her interpretation of the Bible that prohibited her from putting certain foreign substances, including vaccinations, in her body because it was a “Holy Temple.” Williams told Luedtke that she believed that receiving a vaccination would violate that religious prohibition. Luedtke told Williams that if she did not receive a vaccination she would be terminated. Specifically, Luedtke told Williams that if she did not get the shot, “Consider this your last day.”

    Ms. Willliams had provided a letter ci the Bible and from friends and relatives citing the sincerity of her belief. The official refused to accept the letter and Williams submitted to the flu shot in order to maintain her employment. The DOJ concluded that the Center could have reasonably accommodated Williams’ religious objection to receiving the mandatory flu shot. The Center’s refusal to allow Williams to verify the sincerity of her religious exemption request by using something other than a letter from a clergy member was unjustified. In fact, since Williams filed her charge, the Center changed its policy and no longer requires a letter from a clergy leader to obtain a religious exemption to the flu vaccination requirement. The Center is a public, non-religious employer. The requirement that the letter be from a clergy leader was not necessary for the Center’s business purposes and was not related to the Center’s business operations.

    FILE A COMPLAINT SOONER RATHER THAN LATER. If you are discriminated against, time is of the essence!  You have a window of 180 days.

    Mr. Phillips explains that an employer (with 15 or more employees) is under obligation from the Federal Government to adhere to the civil rights act of 1964. 

    “You request a religious exemption, whether or not your employer offers it. You request it and that triggers their legal obligation to accommodate it. They have to accommodate you unless they can prove it will cause them ‘undue hardship’. What that usually means, it’s going to cost them a lot of money.”

    “Title VII requires an employer, once on notice that a religious accommodation is needed, to reasonably accommodate an employee whose sincerely held religious belief, practice, or observance conflicts with a work requirement, unless doing so would pose an undue hardship. Under Title VII, the undue hardship defense to providing religious accommodation requires a showing that the proposed accommodation in a particular case poses a “more than de minimis” cost or burden. Note that this is a lower standard for an employer to meet than undue hardship under the Americans with Disabilities Act (ADA) which is defined in that statute as “significant difficulty or expense.”

    Mr. Phillips said that in all the 500 cases he’s been involved in the past seven years, not a single employer has claimed undue hardship due to an exemption of the flu shot by employees.

    When an employee requests a religious accommodation, the employer has an obligation to provide that to the employee. Time is of the essence! EEOC Title VII of the Civil Rights Act (Title VII) charges must be filed with EEOC within 180 days of the alleged discriminatory act.

    Again, to preserve the ability of EEOC to act on your behalf and to protect your right to file a private lawsuit, you should contact EEOC promptly when discrimination is suspected: The U.S. Equal Employment Opportunity Commission (EEOC), 1-800-669-4000 (toll-free) or 1-800-669-6820 (toll-free TTY number for individuals with hearing impairments).

    Fortunately for now, the majority of hospitals appear to recognize a Title VII right for their employees to refuse vaccines for religious reasons, and most of the healthcare worker have been successful in refusing vaccines and keeping their jobs without facing the decision of whether or not to sue. As long as you avoid the legal pitfalls and your employer has a religious exemption policy, there’s a good chance of success.

    What Is the WORST Thing You Can Do When Filing For a Religious Accommodation?

    Mr. Phillips reiterated that the worst thing an employee can do when requesting a religious accommodation is to mention vaccine harm.

    The last thing you want to do on a statement of religious beliefs is mention that vaccines are harmful because that’s a medical issue. It’s not about whether they ARE or AREN’T harmful. That’s a question, according to the courts and the law anyway, that’s going to be ultimately answered in science. So that is NOT A PROTECTED RELIGIOUS BELIEF.

    Exemption Policies That Violate Civil Rights

    • What if my employer has a “religious exemption” but I have to get “clergy support” (e.g. a letter from a minister stating it is against my organized religious beliefs)? That is a blatant violation of civil rights! You do NOT have to be a member of a religious organization. 
    • Religious Exemptions for the Non-Religious Individual. You don’t have to believe in a western theological deity! In fact, an atheist can have a firmly held belief against the animals use in vaccines and have their vaccine exemption protected under the protection against “religious discrimination.”

    WATCH OUT FOR LEGAL PITFALLS!

    The definition of “religion” in terms of the law is different than the “common sense” idea of religion. Mr. Phillips warns the viewer, “If you are in a situation in the employment arena where you have to state your beliefs, do your research and hire an attorney to draft your letter that is legally sound.”

    You can’t “unsay” statements. Once you put it out there, you are pretty much stuck with it. The safest thing is to consult a knowledgeable attorney in order to protect your right to vaccine exemption so that you can approach this from the start from a legally sound place. That’s going to give you the best chance of succeeding in your goal of exemption.

    “The two best ways to make informed decisions on vaccine exemptions and waivers are to consult an experienced attorney, and/or purchase The Authoritative Guide to Vaccine Legal Exemptions e-book. Beware of Internet advice. Even highly reputable sites, including those of alternative medical doctors and vaccine book authors, provide information about vaccine rights that is usually a mixture of accurate and inaccurate information. Some who have relied on anti-vaccine websites have lost exemption rights unnecessarily. If it doesn’t come from an attorney experienced in this area of the law, beware! “

  • Cell Tower at School

    Studies show that prolonged exposure to radiation from cell phone WiFi towers can cause illness and health damages in children and adults and yet the cities and counties keep placing cell towers on school property. There is no resistance from parents or students. Is it because we believe that the government has done long term studies determining that safety of eletromagnectic radiation? They haven’t. 

    With cell masts, there is no ability to turn them off. It’s 24/7/365. So if you work at or attend that school for many years, those people are exposed to the radiation that was measured. And the levels in some of the classrooms were higher than using a cell phone.

    EMF Radiation Proven to Increase Cancer Risk

    A post on facebook from Kate Bates So, now the “10 kids” has been raised to 16 kids & 9 adults within two blocks of a cell tower (AT THE SCHOOL) have cancer!

    In a German study, doctors examined close to 1000 patients to see if living at the same address close to a cell tower for 10 years affected cancer risk. The social and age differences within the study group were small, with no ethnic diversity.

    They discovered that the proportion of newly developed cancer cases was three times higher for those living within 1300 feet (a quarter of a mile) of a cellular transmitter compared to those living further away. In addition, they found that the patients became ill with cancer on average 8 years earlier.

    A distance of 1300 feet (400m) is of particular importance. This is because computer simulation and measurements used in the study indicated that the radiation at that distance or less (the “inner area”) is 100 times greater than emissions beyond that distance (the “outer area”).

    Another important observation from the research is that for the first 5 years of living near a cell phone tower, the risks were no different than someone living far away from one. However, in years 6-10, the cancer risks jumped more than threefold for those living a quarter of a mile or less from a mobile tower.

    Even more concerning, the average age of diagnosis was much younger. Risk for breast cancer, prostate, pancreas, bowel, melanoma, lung, and blood cancer all increased substantially.

    The risks for breast cancer were most significant for those living in the inner area, with an average age of 50.8 year for a cancer diagnosis compared with nearly two decades later (70 years of age) for those in the outer area.

  • Lead Contaminated Water: Boise Schools test 100 times the limit set by the EPA

    Local News reports that 23 schools in the Boise area have a water faucets exposing students to elevated levels of lead. Lead is toxic, and if it makes its way into the still-developing brains of young children, many of the effects can be permanent. Lead can change how signals are passed within the brain, how memories are stored, even how cells get their energy, resulting in life-long learning disabilities, behavioral problems, and lower IQs.

    The news report came out November 30, 2018 regarding the Boise School District. Tests for lead at water faucets and fixtures at 27 schools across the district and of the more than 1,000 tests conducted, nearly 200 tested at elevated levels (above 15 parts per billion) of lead. The tests above the limit span across 23 schools in the district. 

    Borah, Capital, Hillside and Whittier all had at least one faucet or fixture with test results more than 100 times the limit set by the EPA (0.015 mg/L).

    After Fairmont Jr. High School saw elevated results in a test for lead, Boise School District officials say they began supplying water to the 27 schools and began tests of the faucets and fixtures that could be at risk of elevated lead levels. 

    Since October, more than 1,000 tests have been conducted and the nearly 200 fixtures and faucets which tested at elevated levels are in the process of being removed and replaced. In the meantime, the District says it will continue to provide drinking water to those schools, as they have since the initial positive test. 

    While 23 schools saw at least one faucet with elevated lead numbers, Capital High School saw the most test results (44) above the 0.015 mg/L limit set by the EPA. Whittier Elementary School had 22 results above the EPA limit.

    When cells in the brain absorb lead, it tends to affect the frontal cortex, the area responsible for abstract thought, planning, and attention, and the hippocampus, essential to learning and memory. 1

    What are the health effects and dangers of lead?

    But the resulting symptoms vary a lot between individuals, says Jay Schneider, a neuroscientist at Thomas Jefferson University “You don’t often see the same kinds of cognitive dysfunction in all kids,” he says. “From what our research has shown, there are very significant differences in the way different brains respond to this particular toxin.” 1

    Since lead is stored in the body, a person can get poisoned from exposure to just small amounts of lead over a long period of time (chronic exposure).  You do not need to get exposed to just large doses of lead to be poisoned (acute exposure).  It can take months or years for the body to get rid of lead.  A person will continue to be exposed to lead internally even after the actual exposure to lead stops.

    How Does Lead Cause Neurological Damage?

    Lead can be ingested, through water or other contaminated substances–the Environmental Protection Agency limits the amount of lead in water to 15 micrograms per liter, though some toxicologists think that limit should be lowered to 10 micrograms per liter. Lead can also be inhaled or sometimes even absorbed through the skin, though lead can’t move from water into skin, so it’s safe to bathe in lead-contaminated water as long as you don’t drink it.

    Once it’s in the body, lead competes with calcium to be absorbed by the body. There are lots of factors that can affect just how much of the lead is absorbed, but there is an overall higher absorption rate for lead that is inhaled versus ingested. It sticks to red blood cells—doctors usually test the blood for proof of exposure to lead—and then moves into soft tissues, like the liver and lungs. If lead is absorbed into bones, it can stay there for decades and recirculate in the person’s blood if a bone is broken or when a woman is pregnant, potentially poisoning both the mother and the fetus. The amount the body absorbs depends on the route of exposure.  In general, an adult will absorb 10-15% of the lead in the digestive system, while children and pregnant women can absorb up to 50%.  People will absorb more lead if they are fasting or if their diet is lacking in iron or calcium.2

    A local doctor interviewed by 6 On Your Side said: 

    “Any neurological effects, (from exposure to the lead contaminated water fountain) Dr. Mark Uranga of St. Luke’ said, from minor exposure like this are very unlikely.”

    The U.S. National Toxicity Program states:

    The NTP concludes that there is sufficient evidence for adverse health effects in children there is sufficient evidence that blood Pb levels <5 µg/dL are associated with increased diagnosis of attention-related behavioral problems, greater incidence of problem behaviors, and decreased cognitive performance as indicated by
    (1) lower academic achievement,
    (2) decreased intelligence quotient (IQ),and
    (3) reductions in specific cognitive measures.

    There is also limited evidence that blood Pb <5 µg/dLis associated with delayed puberty and decreased kidney function in children ≥12 years of age. There is sufficient evidence that blood Pb levels <10 µg/dLin children are associated with delayed puberty and reduced postnatal growth. 3

    Natural remedies and other preparations for headaches

    Dangers of Tylenol

    Tylenol is hazardous – They Have Known It For 40 years

    Now might not be the best time to tell you that Tylenol has a “black box warning” (the FDA’s strongest drug label warning) and contains the following ingredients:

    Carboxymethylcellulose sodium (a thickening agent), carrageenan (associated with cancer and gastrointestinal disease), citric acid, flavor, glycerin, hydroxyethyl cellulose, microcrystalline cellulose, propylene glycol (a common ingredient in antifreeze that could be neurotoxic), propylparaben (a hazardous substance and endocrine disruptor), purified water, sodium benzoate, sorbitol solution, sucralose, and of course – acetaminophen.

  • Death by Medical Error Hospital Attempt to Cover Up

    At Vanderbilt University Medical Center, the largest hospital in Nashville, a nurse’s error in an attempt to give an anti-anxiety medication to a patient suffering headaches and vision problems prior to an MRI. The patient was accidentally killed when given vecuronium, a drug used in death row executions.  In this case, the drug appears to have caused the patient, who was otherwise stable, to lose consciousness, suffer cardiac arrest and ultimately be left brain dead. The patient died one day later after being taken off of a breathing machine. The hospital failed to let the Davidson County Medical Examiner, who is supposed to investigate all unusual deaths in Nashville, know of the error leading the examiner to believe the death from bleeding and natural causes rather than a medication error.

    The <wrong> drug was then given to the patient, who was then put into the scanning machine before anyone realized a medication mistake had been made. The patient was then left alone to be scanned for as long as 30 minutes, according to the investigation report, before someone realized the patient was not breathing and medical staff began CPR.

    Third Leading Cause of Death? MEDICAL ERROR

    A study by researchers at Johns Hopkins Medicine says medical errors should rank as the third leading cause of death in the United States — and highlights how shortcomings in tracking vital statistics may hinder research and keep the problem out of the public eye.

    The authors, led by Johns Hopkins surgeon Dr. Martin Makary, (listen to his interview) call for changes in death certificates to better tabulate fatal lapses in care. In an open letter, they urge the Centers for Disease Control and Prevention to immediately add medical errors to its annual list reporting the top causes of death.

    Based on an analysis of prior research, the Johns Hopkins study estimates that more than 250,000 Americans die each year from medical errors. On the CDC’s official list, that would rank just behind heart disease and cancer, which each took about 600,000 lives in 2014, and in front of respiratory disease, which caused about 150,000 deaths.

    Medical mistakes that can lead to death range from surgical complications that go unrecognized to mix-ups with the doses or types of medications patients receive. Like the case of August Elliot in Idaho given the wrong medication and died in his father’s arms in the hospital.

    But no one knows the exact toll taken by medical errors. In significant part, that’s because the coding system used by CDC to record death certificate data doesn’t capture things like communication breakdowns, diagnostic errors and poor judgment that cost lives, the study says.
