  • WIN! Schools Can No Longer Bully Parents!

    Vaccine Exemptions Exist in Idaho! We have seen over the years how the schools attempt to deny, coerce and bully parents. This is why we started Health Freedom Idaho. Nobody was talking about vaccine exemption forms, parents didn’t know there were exemptions and schools didn’t provide the information. It was Health Freedom Idaho that brought a bill from the citizens that got the rules from the health department to line up with statute. Then we brought a bill that required the schools to disclose to parents that exemptions were available for their children. It passed the house but died in the Senate in the previous legislative session.

    We have great news!

    The 2021 Passage of House Bill 298: NO LONGER WILL BE THE SCHOOLS/DAYCARES be freely able to bully parents into vaccination against their religious, moral convictions or medical conditions and concerns.

    Immunization exemptions according to the Health and Welfare Website

    Idaho law allows a parent or guardian to claim an immunization exemption for their child for medical, religious or other reasons. A medical exemption must be completed by a licensed physician. It is recommended that exemptions for religious or other reasons be documented on the form provided by DHW Immunization Program. Parents or guardians may also claim an immunization exemption by providing a signed written statement when entering their child into school and/or childcare. In the event of a disease outbreak, children who have claimed an exemption and have not received the immunization against that disease may be excluded from school and/or childcare.

  • Vaccine Exemption Notification Passes the House onto the Senate

    House Bill 133 the notification to parents of vaccine exemptions PASSED the House 52-17-1. A WIN for transparency today in the Idaho House! Many thanks to all the parents who emailed legislators about this important issue.

    This bill was sponsored by Representative Priscilla Giddings. It will require all the school notify parents and guardians of the immunization exemption in the same manner parents are notified of the “requirement to immunize.” 

    Health Freedom Idaho receives dozens of messages each year from frantic parents who have received letters and phone calls from their children’s school regarding vaccination status. Parents are threatened and bullied by staff demanding parents get their child’s vaccines up-to-date within a certain timeframe under threat of exclusion from school. Most often the staff does not provide any disclosure of the availability of vaccine exemptions.

    Health Freedom Idaho gathered a small sample of the correspondence provided by the parents that fails to disclose any option other than vaccination. Clearly, these forms of correspondence from the schools are designed to deceive and intimidate parents.

    It is interesting that 3 Republicans voted with Democrats against informing parents of current Idaho law:

    “We have a lot of frustrated parents throughout the state who feel like they’ve just maybe been misinformed about it,” Gidding, R-White Bird, told the House. “I think we should make sure that the parents have all the information when it comes to immunizing their children.”

    Rep. Tammy Nichols, R-Middleton, spoke out in favor of the bill, HB 133, while also noting that her family owns and operates private schools and daycares.

    “I have no problem with people immunizing their children. My children are immunized to an extent,” she said, “but I have gone through the rounds with my school district to provide this information … that the law does allow for an exemption. …It’s something we should be notified about…For transparency purposes, I believe that it should be included on the forms.”

    Rep. John Green, R-Post Falls, said he was “at a loss to understand how anybody could object” to the idea, but said he heard during the bill’s committee hearing that some groups hoped parents wouldn’t take advantage of the exemptions, which he called “appalling.”

    “We have got to stand up as a Legislature and make sure that parents understand the law, and certainly we can’t contribute to hiding the law by any means,” Green declared.

    It is ILLEGAL for your school to deny entrance to your child because you are exercising your legal right to opt out of vaccinations.

    Contrary to the Health and Welfares website – this School Exemption Form is NOT the only legal means by which a parent can provide their child’s school of a vaccine exemption.
    Idaho Code 39-4802 only requires a signed statement from the parent(s) or legal guardian of the child.

    Unfortunately, Idaho Health and Welfare Immunization Department (IDHW) has made the use of the form mandatory for schools to admit children whose parents have chosen to legally opt out of some or all vaccines for their children. The form developed by IDHW falls far outside the scope of the Idaho Statutes (section 39-1118(2) or 39-4802(2), Idaho Code;). The state prescribed form  based on IDAPA 16.02.15, is in violation of Idaho Code 39-4802 and 39-4804.  

    Currently, parents are forced to sign IDHW’s mandatory form that demands parents state that “vaccine preventable diseases are extremely deadly” and “that it is negligent for willfully denying your son/daughter the life-saving protection that vaccines offer” in order to enroll their children into school.

    These forms are MEANT to not only be intimidating but to catch parents legally off guard.

    The Idaho Statutes make it clear that parents only legal responsibility  is to provide a written statement they are opting out of vaccines for their children and they are aware of the risks/benefits of the recommended vaccine schedule.

    Surveies show that most schools have denied children access to school when parents have submitted the legally acceptable parental statement of vaccine exemption. There are many schools refuse to accept the form if it has been altered in any way.  

    This illegal action on the part of schools (who feel their hands are tied due to Health and Welfare Administrative policy) has caught the attention of Health Freedom Idaho.  While correspondence from the Office of the Attorney General and Legislators have shown that there is in fact a discrepancy in the legal statues and the scope of the form required by IDHW there has been no challenge to change the current administrative procedures to fall back in line with the law.

    Quick Fact: Any minor child whose parent or guardian has submitted a signed statement to school officials stating their objections on religious or other grounds shall be exempt from the provisions of this chapter.  Medical exemptions are also allowed. (See Idaho State Code listed below). 

    • Idaho Statues permit you as an individual or parent have the right to choose whether or not to vaccinate your child.  
    • The statute does not require you to disclose what other grounds your refusal to immunization is. As with any medical decision, the decision to vaccinate or not is a right of the individual or parent.
    • The State of Idaho, your doctor and public health employees cannot force you or your child to be vaccinated.
    • Your child cannot be excluded from a school or public program because you have exercised your right to not vaccinate.
