  • Standing Room Only at Public Hearing for Health and Welfare Rules

    What an amazing turn out in North Idaho today!  So many brave moms and dads.  I’m so thankful for all of you.  Watching all of you fight for your babies today bring me to tears. In that roomful, only 1 person spoke for the “rules”. It was an employee of the system! All the rest were a united bunch! Great speeches!

    Hari Heath I was very impressed by the competent knowledge of the subject so many had; how we came at it from so many angles without being redundant; one set of facts became backed up someone else’s direct experience and how resoundingly cohesive this group of individuals was.
    We couldn’t have done better with a producer and a script!

    Public speaking can pretty nerve-wracking for many.  But you all got up there and just spoke from your heart, respectfully but without mincing words.  It was stressful and no one really wanted to do it but we do because there’s nothing we won’t do for our children.  And we know if we don’t speak today, tomorrow may be too late.

    This Saturday was a very sobering reminder to me of the cost some of our children have already paid and those who ultimately lost their lives, as I ran into my friend Shelly.  Some of you may recognize her from Pilgrim’s.  Her family paid the ultimate price, along w 3 other families in North Idaho and a total of 11 families between here and Spokane just in the same month her Vance died.  

    This is why we do what we do.  For babies like Vance and so our children or anyone’s children never again have to suffer the devastating destruction that vaccines can cause.

    According to an article in Idahoednews – Health and Welfare is also getting emails on the issue, but in this case, the headcount is quite different. While 28 Idahoans argued against immunization rules, 62 Idahoans urged Health and Welfare to keep the rules in place, Nathan Brown of the Idaho Falls Post Register reported.

    • Let’s do this!! Do you agree that Idaho should have vaccine requirements = mandates?
    • Do you think that parents should be fully informed of exemptions available?
    • Do you think that it should take more than 12 people to decided the fate of 30,000 students to receive another shot of meningitis before graduation?
    • Do you think that they should be allowed to change the wording of the rules – to ‘student’ with the intent to include ADULT STUDENTS in their mandates?

    I OPPOSE  IDAPA 16.02.15 and 16.02.11 Requirements for Immunizations

    36 required school vaccinations

    31 required daycare vaccines (by the age of 2)

    These rules violate informed consent, bodily autonomy, parental rights, medical privacy, and doctor-patient privilege.These rules represent a clear violation of human rights as they go beyond the scope of the law and seek to coerce and bully parents into compliance. Forcing the injection of liability-free medical products into an individual in order to participate in education in public and private schools and participate in private business via daycares.

    • Rules 16.02.15 and 16.02.11 must be stricken or at very least amended to reflect a “recommendation” rather than a requirement/mandate. The Health and Welfare Department must be more transparent and specify that exemptions are available.

    16.02.11 Meningitis for 12th graders for school year 2020/2021

    Additional Meningitis vaccination for 12th grade students

    This additional vaccine requirement was added for the 20-21 school year under the guise that it would protect potential college-bound students from the exceedingly rare disease that affects less than 400 individuals a year. The Health Department reports that LESS THAN 3 individuals annually in Idaho and NO reported students have been effected in the last decade. The CDC reports that 92% of the college students who got meningitis WERE VACCINATED with this vaccine. Not surprisingly, 99.9% of those who were in favor of the vaccine at public hearings stood to gain financially from the newest Idaho vaccine mandate.The parents of the 30,000 students a year who are now mandated to receive an additional vaccine are not being provided true Informed Consent. (Meningitis Facts)

    We need your support.  The Idaho Department of Health and Welfare will be hosting 6 public hearings around the state and one of the important topics will be immunizations, vaccine exemptions, CPS, and medical testing requirements for infants . We encourage you to email a letter and let the Idaho Health Department and your legislators know that you believe that immunizations should be a parental choice, that you are concerned about the overstep of the Health Department through the CPS and/or your concerns about forced medical testing on your newborn. There are hundreds of rules that are open for public comment. You are available to speak on any or all that concern you.

    Anyone may submit written comments regarding the proposed rule making. Those comments should be submitted in writing. We have made it easy simply COPY/Paste EMAILS Addresses and compose your email. Be sure to make plans to attend the public hearings, read your comments and support others who are doing the same.

    KEEPING THE RULE MAKERS ACCOUNTABLE

    HFI Concerns with IDAPA RULES…

    The department of Health is under the executive branch and gets to ‘make the rules’ that pertain to the laws the legislators vote on in session. We have seen in the past that the Department stretches the law past its intention in an attempt to bully parents into compliance under their terms and not those of the statute. With closer examination, it appears the Health Department’s administrative rules are rewritten AFTER the legislator’s vote upon them. Does this mean that those ‘writing the rules’ aren’t following the rules?? 

    Whose suppose to keep them accountable? WE ARE- the public! 

    WHAT DO I SAY?

    These are some samples of rules that are unlawful and unconstitutional. Your comments should not be limited to these issues below. Look through the rules and determine if there are other areas that you feel should be brought to the attention of our legislators. (Link to the RULES FROM HEALTH AND WELFARE) 

    Here is a link to several letters sent by active health freedom Idaho members who volunteered to share. 

    Health Freedom Idaho believes that the ultimate responsibility to protect the health and the welfare falls not on bureaucrats or politicians but on parents. In order to preserve informed consent, bodily autonomy, parental rights, medical privacy, and doctor-patient privilege ALL medical decisions should be left in the hands of parents and their doctor and not mandated by the state.

    IDAPA 16.03.09 Department of Health & Welfare Medicaid Basic Plan Benefits

    Each participant must demonstrate that he has received recommended wellness visits and immunizations for his age prior to earning any points. (3-30-07)

    Implying to an already vulnerable population they MUST use a liability-free medical products in compliance with ACIP vaccine schedule discriminates against religious/personal beliefs and personal autonomy.

    • Rule 16.02.09 must be stricken. Health and Welfare must be more transparent of parental rights and Idaho law and in no way punish or reward an at-risk population for elective medical procedures.

    IDAPA 16.06.12 – Rules Governing the Department of Health and Welfare Idaho Child Care Program (ICCP)

    ICCP can only receive child care benefits for eligible children. A child is eligible for child care benefits under the following conditions: (4-2-08) 01. Immunizations Requirements. A child must be immunized in accordance with IDAPA 16.02.11, “Immunization Requirements for Children Attending Licensed Daycare Facilities in Idaho.” Child care benefits can continue during a reasonable period necessary for the child to be immunized. Parents must provide evidence that the child has been immunized unless the child is attending school. (4-2-08)

    Implying to an already vulnerable population they MUST use a liability-free medical products in compliance with ACIP vaccine schedule discriminates against religious/personal beliefs and personal autonomy. The Health Department should at no time withhold benefits for at-risk families in order to force compliance for an elective liability-free medical procedure. 

    • Rule 16.06.12 must be stricken. Health and Welfare must be more transparent of parental rights and Idaho law and in no way punish or reward an at-risk population for elective medical procedures.

    16.02.12 – PROCEDURES AND TESTING TO BE PERFORMED ON NEWBORN INFANTS

    The government-mandated medical procedure must be weighed against the individual’s constitutionally protected interests in personal autonomy and bodily integrity. Mandated testing includes blood draw to test for 47 conditionsAll medical decisions need to be left between doctor and parent and should not involve bureaucrats or legislators. 

    • Rule 16.02.12 Should be stricken or at very least written as a recommendation NOT state mandated medical procedures. 

    RE: IDAPA 16 Department of Health and Welfare Docket 16-0000-1900f

    Rules 16.06.01(559)(01) and (02) Rules for Conducting a CPS Investigation

    Are two rules that state anytime CPS is conducting an investigation or comprehensive safety assessment (01) an interview of the child must be conducted. CPS can not constitutionally require an interview of a child under the 4th and 14 amendments of the Constitution. Our bill of rights protects us from the government in areas of search and seizure.

    • Rule 16.06.01 (559) 01 and 02 should be stricken as unconstitutional. These rules allow agencies to operate outside the scope of the U.S. Constitution violating rights protected by the 4th and 14th amendments.

  • How Can They Just Change The Rules Like That?!

    Did you see the new rules? The Health Department is busy this summer and your IMMEDIATE ATTENTION NEEDED! This Thursday and Friday, you the citizen, has the opportunity to use voice and direct the outcome of the rules that affect your family. Our state government is structured in a way that the statutes are voted upon by the Legislature from January to March of each year. The rules (application of those statutes) are directed by the individual state departments throughout the rest of the year. These rules are made up by the departments, but they require public meetings. However, when the public doesn’t attend and our concerns aren’t voiced, the rule changes can seriously impact our daily lives of the citizens. There are two rules they are proposing. One we can get behind and the other needs strong opposition. Please join us! Be Prepared to Testify for 3 minutes. Public speaking IS NOT REQUIRE!     Voice your approval for the temporary rule that clarifies the use of a parental written statement for vaccine exemptions for school and daycare. Changes to IDAPA 16.02.15 Immunizations

    Idaho legislators and interested stakeholders have identified the need to clarify this rule to ensure that the immunization exemption/opt-out language therein is consistent with Section 39-4802, Idaho Code, and legislative intent.This rulemaking adds language clarifying that parents requesting an immunization exemption may do so either on the Department’s standard form or in a written, signed statement indicating their choice to exempt their child from immunization requirements.

    *This rule has been added temporarily in order to help parents enroll in school and daycare programs. We must still voice our approval so that it will remain.

    Voice Your Disapproval for the increased vaccine requirements for high schools students.

    NEW IMMUNIZATION REQUIREMENT FOR SCHOOLS
    The Department invites interested stakeholders to participate in negotiated rulemaking for this chapter, IDAPA16.02.15, “Immunization Requirements for Idaho School Children.” The purpose of this rulemaking is to add a new school entry immunization requirement to require a second dose of meningococcal (MenACWY) vaccination beforea student enters the 12th grade in Idaho, starting with school year 2020-2021. If a student received their first dose ofmeningococcal (MenACWY) vaccine at 16 years of age or older, they will not be required to receive the second dosebefore entry into the 12th grade.

    In 2015 there were a total of 375 cases NATIONWIDE. In 2016 it reached a historic low rate of .12 per 100,000 people a total of 370 cases nationwide.

  • NO H707 Health Dept To Make Medical Decision WITHOUT Parental Consent

    UPDATE! H 707 bill died in committee, it wasn’t heard or voted upon. A bill number was printed and it was ‘laid to rest’ in the Chairman’s drawer. Some suspect that it was brought forth to see if the public was paying attention. We were and they know it!

    NO on H 707. Not only does Idaho have bad language allowing Sheriff “emergency child removal” without a court order which we’ve already seen abused. But now there is a bill which would allow the health department to make medical decisions for children, without parental consent or a court order. Please contact the House Health and Welfare Committee and let them know this is not acceptable to Idaho parents!

    HB707 Is a BAD bill that, if passed, will remove parental medical decision making authority and turn it over to the Dept of Health and Welfare.

    This bill amends statutes 16-1602, 16-1609, and 16-1629.

    16-1602 Removes medical, dental, psychiatric, etc decision making from the person that has legal custody.

    16-1609 Provides the H&W Dept the right to authorize evaluation and treatment of children taken into shelter care.
    “…the department shall attempt to
    obtain parental consent by one (1) parent.”
    If the parent denies consent or is unable to be contacted, the department shall have the right to authorize treatment.”

    This is unacceptable!

    16-1629 If the Dept is given custody of the child then the Dept has the right to authorize all kinds of medical treatments for you child including surgery.
    “…and to authorize surgery if the surgery is deemed by two (2) physicians licensed to practice in this state to be necessary for the child.”

    It sounds like they will use the declaration of imminent danger to take kids into custody and get them medical care when they are removed from the home. This does away with the currently required court order.

    Remember baby Elijah? He was taken on his first day of life and put into shelter care in CDA last year. The baby was taken wrongfully and the judge gave the baby back to mom and dad. If this bill were law at that time the Dept would have had the authority to vaccinate their baby without parental consent.

    66% of Idaho children taken by the state and placed in foster care were RETURNED to their parents. Wow! The state held physical custody of 770 children for length of time (talk about nightmare) but parents NEVER lost legal custody. These 770 children were returned home, because a judge felt that the parent posed no threat to the child’s health or welfare. The State Health and Welfare department should NEVER have the authority to treat a child outside parent’s consent.

    The 3 Topics that will be the focus of Health Freedom Idaho this session are

    NATUROPATHIC LICENSING
    HEALTH FREEDOM IDAHO POSITION: OPPOSITION
    • Licensing through the state is not necessary, and is not time or cost effective.
    • Licensing restricted to a few accredited schools would stifle and eventually destroy naturopathy in Idaho. This exclusivity would soon drive out competition, new ideas, and new practices that are the lifeblood of our state and country.
    • This would create unemployment for most of the naturopaths in Idaho.
    REPEAL OF “FAITH HEALING” EXEMPTION
    HEALTH FREEDOM IDAHO POSITION: OPPOSITION
    • Removing this exemption is in violation of the constitution. The first amendment states that, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.”
    • Alternative treatment choices by parents for their children should not be criminalized.
    • Parents actively seeking healing and/or treatment for their child in means that differ from the AMA should not be subject to criminal charges of abuse or neglect. A recent Johns Hopkins study shows that medical errors are the 3rd leading cause of death in our nation. There are already specific Idaho statutes in place to protect children from intentional physical abuse.
    IDHW IMMUNIZATION EXEMPTION FORM
    HEALTH FREEDOM IDAHO POSITION: OPPOSITION
    Idaho Statute permits a parent/guardian:
    1. The right to choose whether to vaccinate their child
    2. The right to choose to participate or decline participation in the state vaccine registry system
    (IRIS).
    • IDHW REFUSES to accept the legally approved signed parental affidavits forcing schools to deny admission to children. Parents enrolling children in schools and daycare are being forced to complete IDHW’s mandatory immunization form. The form is designed to make parents state they are guilty of medical neglect, denies parents’ legally protected medical privacy, and violates their legally protected right to opt out of the State Registry.
    • Idaho Department of Health and Welfare has imposed IDAPA RULE 16.02.15 (110.02), creating the mandatory IDAHO CERTIFICATE OF IMMUNIZATION EXEMPTION for school and daycare admission.
    • However, the only requirement of parents under Idaho Code is stated in 39-4802(2): to “submit a signed statement to school officials stating an objection on religious or other grounds.” The state-prescribed form, based on IDAPA 16.02.15, is in violation of Code 39-4802 and 39-4804. The form developed by IDHW falls far outside the scope of Idaho Code 39-1118(2)and 39-4802(2).

    Senate Bill #1050
    Clarifies Section 39-4802 (2)Idaho Code that a parent has the legal right to enroll their child(ren) in Idaho schools, while maintaining their privacy, their right to medical confidentiality, and the right to opt out of providing IRIS-type vaccination information. 

    Parents’ rights, privacy, confidentiality, and the right to shield oneself from unjust incrimination are paramount to Idahoans and of utmost importance in maintaining liberty.  This bill will secure those natural rights.

    Idaho has clearly stated in existing laws that parents are legally able to opt out of some/all vaccines for their children when enrolling in daycare or public school.  The Public Health Department has created administrative procedures that intentionally discriminates against a minority group, violates their privacy, and denies their children access to schools when they opt to take their legally allowed vaccine exemption.

    1. IDAHO STATUES CLEARLY STATE: VACCINES ARE NOT MANDATED FOR DAYCARE or SCHOOLS.
    2. IDAHO STATUES CLEARLY STATE: PARENTS MAY SUBMIT A WRITTEN STATEMENT THAT THEY ARE CHOOSING TO EXEMPT THEIR CHILD FROM SOME/ALL VACCINES.

    Department of Health will NOT ACCEPT the legally acceptable written statement from parents.

    Department of Health has created a form that violates family’s rights and in turn forces school officials to deny children entrance into schools

    • Parents are forced to sign IDHW’s mandatory form that demands parents state they are putting their children at risk to contracting disease that carry serious complications.

    • IDHW’s form was intentionally created to gather data from parents for the purpose of submitting that data to a ‘voluntary’ vaccine tracking database. Removing parental right to privacy and legal option to OPT OUT of the registry.
    • The Health Department refuses to accept a legally acceptable signed parental affidavit. A blatant disregard for Idaho statue. Discriminating against families who choose to invoke their legal option to vaccine exemption.
     
    The Public Health department is getting away creating procedures that contradict the law and children are being denied access to daycare and schools.

    The purpose of this bill is to clarify Section 39-4802 (2)Idaho Code.

    The current language is as follows:

     (2) Any minor child whose parent or guardian has submitted assigned statement to school officials stating their objections on religious or other grounds shall be exempt from the provisions of this chapter.

     Original Intent

    The original intent of this section was that an Idaho parent/ guardian may exercise their right to privacy and medical confidentiality by simply submitting a signed statement to school officials in

    order to invoke their right to exemption regarding the state-prescribed vaccination schedule for school enrollment.

     Rules Created Mandating Unjust Form

    Rules have since been created requiring a state health department form be mandated. The form that was created for this purpose contains unnecessary, possibly incriminating language that is far outside the scope of this section.

     

    Section 39-4804 Idaho Code is being disregarded in the forced use of the current mandatory exemption form. That section states in part:

     

    NOTIFICATION TO PARENT OR GUARDIAN.

     (b) Participation in the immunization registry is voluntary;Because the Idaho IRIS vaccine registry is voluntary, a parent is not requiredto disclose vaccination status to the state.

     Form Forces Parents to Give Up Rights or Child’s Education

    By mandating the current exemption form, which listsindividual vaccines and demands confidential medical information, parents arenot able to exercise their right to privacy and exemption without facingenrollment denial by schools. Clearly this form does not align with theintentions of the current statutes.

     This Bill Will Re-secure Idahoan’s Rights to Privacy, Confidentiality,& Avoidance of Unjust Incrimination

     This bill would modify for clarification Section 39-4802 (2)to read:

     (2) Any minor child whose parent or guardian has submitted asigned statement to school officials stating their objections on religious orother grounds shall be exempt from the provisions of this chapter. The signedstatement may appear in a letter from the parent or guardian and is notrequired to be made on a form furnished by the state board of health andwelfare, a school, or another entity.

     This clarifies that a parent has the right to enroll their child(ren) in Idaho schools, while maintaining their privacy, their right to medical confidentiality, and the right to opt out of providing IRIS-type vaccination information. Parents’ rights, privacy, confidentiality, and the right to shield oneself from unjust incrimination are paramount to Idahoans and of utmost importance in maintaining liberty.  This bill will secure those natural rights.
