  • U.S. Senate Votes To Legalize Hemp Farming

    The non-psychoactive cannabis cousin of marijuana would finally become legal to grow in the United States under a bill overwhelmingly approved by the Senate. We hope that this bill passes as it will end the confusion about hemp in our state and the country. The wide-ranging agriculture and food policy legislation known as the Farm Bill, passed by a vote of 86 – 11 on Thursday, contains provisions to legalize the cultivation, processing and sale of industrial hemp. With over 25,000 products being made from hemp just imagine how much $$$ that can mean for America and our farmers. #HempFarmAct#FarmBill

    The wide-ranging agriculture and food policy legislation known as the Farm Bill, passed by a vote of 86 – 11 on Thursday, contains provisions to legalize the cultivation, processing and sale of industrial hemp.

    The move, championed by Senate Majority Leader Mitch McConnell (R-KY), would also make hemp plants eligible for crop insurance.

    “Consumers across America buy hundreds of millions in retail products every year that contain hemp,” McConnell said in a floor speech on Thursday. “But due to outdated federal regulations that do not sufficiently distinguish this industrial crop from its illicit cousin, American farmers have been mostly unable to meet that demand themselves. It’s left consumers with little choice but to buy imported hemp products from foreign-produced hemp.”

    McConnell also took to the Senate floor on Tuesday and Wednesday to tout the bill’s hemp legalization provisions in separate speeches.

    In April, the GOP leader introduced standalone legislation to legalize hemp, the Hemp Farming Act, the provisions of which were included in the larger Farm Bill when it was unveiled earlier June 2018.

    The Senate Committee on Agriculture, Nutrition and Forestry approved the bill by a vote of 20-1 two weeks ago.

    During that committee markup, Sen. Charles Grassley (R-IA), one of Congress’s most ardent opponents of marijuana law reform, threatened to pursue serious changes to the bill’s hemp provisions on the floor. Namely, he wanted to remove the legalization of derivatives of the cannabis plant, such as cannabidiol (CBD), which is used by many people for medical purposes. But Grassley never ended up filing a floor amendment, allowing hemp supporters to avoid a contentious debate and potentially devastating changes to the bill.

    Hemp legalization enjoys broad bipartisan support.

    “Legalizing hemp nationwide ends decades of bad policymaking and opens up untold economic opportunity for farmers in Oregon and across the country,” Sen. Ron Wyden (D-OR) said upon passage of the Farm Bill on Thursday. “Our bipartisan legislation will spur economic growth in rural communities by creating much-needed red, white and blue jobs that pay well. I’m proud to have worked with my colleagues to get the bipartisan Hemp Farming Act through the Senate. Today marks a long-overdue, huge step forward for American-grown hemp.”

    Earlier this month, the Senate approved a nonbinding resolution recognizing hemp’s “growing economic potential.”

    “For the first time in 80 years, this bill legalizes hemp. We forget, but hemp was widely grown in the United States throughout the mid-1800s,” Sen. Michael Bennet (D-CO) said in a floor speech on Wednesday. “Americans used hemp in fabrics, wine, and paper. Our government treated industrial hemp like any other farm commodity until the early 20th century, when a 1937 law defined it as a narcotic drug, dramatically limiting its growth. This became even worse in 1970 when hemp became a schedule I controlled substance. In Colorado, as is true across the country–I have talked to a lot of colleagues about this–we see hemp as a great opportunity to diversify our farms and manufacture high-margin products for the American people.”

    McConnell’s standalone hemp bill currently has 29 cosponsors signed on—17 Democrats, nine Republicans and two independents.

    A Congressional Research Service report released last week says that the “global market for hemp consists of more than 25,000 products.”

    House Republican leaders blocked a vote to make hemp legalization part of that chamber’s version of the Farm Bill. But now that the language is included in the version approved by the Senate, it will be part of discussions by the bicameral conference committee that will merge both chambers’ bills into a single piece of legislation to be send to President Trump’s desk. All indications are that McConnell, as the most powerful senator, will fight hard for the survival of his hemp proposal.

    A White House statement of administration policy released this week outlining concerns with the Farm Bill does not mention its hemp legalization provisions.

    In 2014, McConnell included provisions to allow limited state-authorized hemp research programs in that year’s version of the Farm Bill.

    Kentucky’s agriculture commissioner cheered the passage of the new hemp provisions on Thursday..

  • WHY Did HFI Stand Opposed To CBD Oil Legislation?

    Health Freedom Idaho believes strongly in the right of citizens to choose their own modes of healing. This includes access to natural supplements H577 requires a doctors note in order to purchase any products with CBD containing less than .3% THC. HFI is concerned about the unintended consequences of this legislation.

    Well intended bills can have unintended consequences. 

    Rep. Dorothy Moon’s bill HB410 is just that. Rep. Dorothy Moon is a wonderful legislator and a freedom fighter. She has heard the voice of her constituents that are asking for CBD oil to be legalized in our great state. She attempted several version of the bill, none of which the Attorney General would support. Understandably, Rep. Moon wanted to bring a bill that would be successful, but in so doing the proffered legislation has lost the liberty that she intended to provide. You see, the Attorney General has a compelling interest for the state, while legislators should have a compelling interest for the people.

    After days of study I have come to the conclusion that some of the unintended consequences of this bill are the following:

    • The citizen (who must be 18 years of age) is required to go to an MD. The MD will have to indicate that the individual suffers from an illness and may benefit from treatment with cannabidiol. Do you want the decision to use CBD products taken out of your hands and put into the hands of a medical doctor?
    • Once you submit to the authority of the MD, you will then have to submit to the authority of the state by providing your name, address, photo identification, along with any other information the board considers necessary in order to obtain a registration card.
    • What if you want to use CBD oil for your child? Well, the rules are a bit different. You, the parent, will then have to acquire a signed statement from a neurologist indicating that a minor in the parent’s care suffers from an illness and may benefit from treatment of cannabidiol oil. Parents, do you want this decision taken out of your hands and placed into the hands of a neurologist who may or may not have education in CBD oil at all? You will then have to continue the process of applying to the state for your registration card.
    • Keep in mind that the card is only good for ONE YEAR so you will have to repeat this rigmarole YEARLY.
    • A board will have to be created to oversee these registration cards. This costs the taxpayers’ money. This board will maintain a database of records including the name of each registrant and the name of each minor receiving care from the registrant. Do you want you or your child’s personal health information kept and overseen by a state run board?

    The police will then have to start enforcing this new law. I can see it now. The police officer pulls over the soccer mom on her way to taking her kids to school. He discovers her smoothie is made from hemp milk! Gasp! “I’m sorry Ma’am but do you have a registration card for that hemp milk?” Hopefully she didn’t add the hemp hearts from Costco to her smoothie that morning. That’s right! Your hemp products such as shirts, twine, purses, cooking oil, and milk will come under the authority of this law. What a waste of taxpayer money!

    The registration card is really the crux of this issue and is what the Attorney General required in order to support the bill. Now why do you suppose that it is important to the Attorney General that a registration card be required? MORE REGULATION and BUREAUCRACY!

    There are some pretty scary consequences to having the state tracking the method you choose for healing. Most do not understand the marijuana plant nor the properties that provide healing without enough THC to bring the high that most people associate with the plant. Most do not understand that when a product has less than .3% THC that it is considered food according to the federal definition. (See https://hfi.designbyparrish.com/cbd-oil-from-hemp).

    Do we really want to be begging the state for permission to use the products that we see fit to use? According to my research, it wouldn’t be a stretch to say that refined sugar is more dangerous than hemp products.

    In other states that require a registration card for marijuana we see that the state is denying the citizen’s right to gun ownership.

    Could the government potentially require gun owners to turn in their firearms?

    An Oregon mother had her child taken by CPS and put into foster care for months. The mother was using marijuana recreationally which is allowed in the state of Oregon. The boyfriend had a registry card as both a grower and a patient but the child was still taken into shelter care because he was growing the plants. The mother did eventually win in court and got her daughter back but at what cost both financially and emotionally?

    You see, the medical marijuana card may protect the right to obtain and use a substance but it is being used to target other rights. I think that we should learn from what is happening in that other states and not open the door here.

    There are more possible unintended consequences to consider about this registration card. How will this record affect a truck driver’s CDL, a practitioner’s medical license, the cosmetologist’s license or any other occupational licensing for that matter?

    We should never expect our legislators to hand out laws like candy. They are to uphold their oath of office which is to support the constitution. Each legislator takes this oath when sworn into office, “I do solemnly swear (or affirm, as the case may be) that I will support the constitution of the United States and the constitution of the state of Idaho, and that I will faithfully discharge the duties of senator (or representative, as the case may be) according to the best of my ability.”

    I believe that the citizens should be asking for a better path that would Rep. Moon to both uphold her oath and also make CBD oil available to all who would like to use it.

    We will have more information coming out soon for those looking to understand the multiple factors surrounding this issue. Idaho’s attorney general interprets Idaho law to mean that any amount of THC is a controlled substance and the DEA has overstepped their bounds. 

    There is a lot to learn here in order to be prepared to defend your rights to access something as benign as CBD oil with less than .3% THC. When we see such a desire to control something with proven useful, nourishing, and healing properties we must ask the all-important question, “WHY?”


    UPDATE on the status of the bill. 

    Dorthy Moon removed the tracking portion and the bill got a new name – HB 577.

    It passed Idaho State Affairs Committee with a solid 12-0 vote. 

    House voted in favor of the bill with a whopping 59-11 vote ‘Aye’. 

    The Bill stalled in the Senate Health and Welfare Committee as Chairman Heider refused to allow the bill to be heard.

    ACTION ITEM: Sign the petition that asks the incoming Trump administration to legalize CBD supplements nationwide.

    Meaning an extract containing one or more cannabinoids that has been derived from any plant of the genus Cannabis, other than the separated resin (whether crude or purified) obtained from the plant.

     In effect, the DEA has, completely outside any act of Congress, created an entirely new “Schedule I” controlled substance it calls “Marihuana Extract” (note the spelling with an “h” rather than a “j”). This “Marihuana Extract” is, according to the DEA, any extract containing “one or more cannabinoids…”

    CBD is, of course, a non-psychoactive cannabinoid. It’s just one of over a hundred cannabinoids found in hemp extracts, which also include CBD-A, CBG, CBC, CBN and so on.

    The sky is not falling! Hemp Industry Association responds…

    From the Hemp Industry Association, here’s a thoughtful response on all this, which insists the DEA’s new classification is not a show-stopper:

    Yesterday the Drug Enforcement Administration (DEA) issued a Final Rule on the coding of marijuana extracts. Unfortunately some misleading media stories and social media postings lead quite a few people to panic at reports that CBD was being banned under this new rule. 

    The Sky is NOT Falling. The Final Rule published by DEA did not change the legal status of CBD. This can only be done by a scheduling action which has NOT occurred. 

    HIA has carefully reviewed this with our legal advisers and discussed it with industry experts. While there are some differing opinions on the effect of the rule, there is general agreement that yesterday’s ruling did not change the status of CBD. Here are some important facts to know:

    • Cannabidiol is not listed on the federal schedule of controlled substances
    • Sec. 7606 of the Farm Bill defines hemp as distinct from marijuana and does not treat it as a controlled substance when grown under a compliant state program
    • Despite these facts, DEA has stated that CBD is a controlled substance previously
    • HIA strongly disagrees with the DEA position and is ready to take action to defend should DEA take any action to block the production, processing or sale of hemp under Sec. 7606
    • The Final Rule published on December 14th was not a scheduling action but rather an administrative action related to record keeping
    • The code assigned to “marihuana extract” in the rule is “Administration Controlled Substances Code Number” for the purposes of identification of substances on registration forms 
    • The rule was originally published as a proposed rule in 2011 BEFORE the Farm Bill and didn’t mention CBD or hemp
    • DEA confirmed to a reporter from the Denver Post that this was an administrative action and did not change the status of CBD in federal law

    So what does this all mean? We believe the DEA rule on “marijuana extracts” was not directed at hemp derived CBD products and has been in the works for 5 years. We also believe there is no imminent change in DEA policy regarding hemp derived CBD products. 

    For now, we want to urge everyone to calm down and continue with your businesses. We also hope that in future, reporters will take the time to get the facts before posting misleading stories about hemp and CBD.


    The industry plans to fight the absurd DEA classification with lawsuits and petitions

    The CBD industry, naturally, is planning on waging a fierce battle to keep CBD products legal in all 50 states. Via Leafly:

    Robert Hoban, a Colorado cannabis attorney and adjunct professor of law at the University of Denver, raised the notion that the rule itself may not be lawful. “This action is beyond the DEA’s authority,” Hoban told Leafly in an interview late this afternoon. “The DEA can only carry out the law, they cannot create it. Here they’re purporting to create an entirely new category called ‘marihuana extracts,’ and by doing so wrest control over all cannabinoids. They want to call all cannabinoids illegal. But they don’t have the authority to do that.”

    The CBD industry, in fact, has been looking for an opportunity to challenge the DEA in court, and it looks like that time has arrived.
