  • Idaho Vaccine Exemption for Daycare & Schools

    No shots, no school is simply not true! A signed parental statement is the only thing necessary to evoke your child’s immunization exemption.

    YES, there are 3 Exemptions to Vaccines for Idaho. Idaho law allows a parent or guardian to claim an immunization exemption for their child for medical, religious or other reasons. A medical exemption must be completed by a licensed physician. While the schools or daycare might recommend that exemptions for religious or other reasons be documented on the form provided by the Idaho Department of Health and Welfare, Immunization Program the law does NOT REQUIRE A FORM.

    Parents have a right to OPT their children out of some (or all) state-mandated vaccines for daycare and school. The three exemptions for the state are medical, religious, and ‘other.’

  • NEW RULES! Health Department Will Have To Follow The Law. WIN FOR HEALTH FREEDOM!

    Health Freedom Idaho has spent the last two years going head to head with Idaho Department of Health and Welfare over their ‘immunization exemption form’.  The form was purportedly ‘required’ by all schools and daycares in accordance with a rule created by IDHW. The problem? This RULE created by a state department directly undermined an existing Idaho STATUTE (law).  Parents, schools and legislators recognized the issue prior to HFI involvement. State Representative Heather Scott brought it up with the Idaho Attorney General, who made it clear that the health department should NOT encourage schools to deny entrance to children whose parents had complied with the statute and submitted a signed statement invoking exemptions (in place of the falsely required form). 1  

    Health Freedom Idaho presented multiple bills, over the course of the last two legislative sessions, addressing this inconsistency. SB 1050  and SB 1227  were each created to clarify that parents submitting written statements, in accordance with Idaho Statute regarding exemptions, was perfectly legal procedure for invoking exemption status for their children, rather than being coerced into using the IDHW exemption form. Neither bill was ever heard. The chairman of the senate health committee drawered them to avoid allowing these bills to be voted on by the entire legislature. This allowed IDHW to continue undermining law and train school staff to (illegally) deny the enrollment of children to schools and daycares whose parents chose to forego THEIR “official” form. The health department even went so far as to suggest that school staff go behind parents’ backs by filling out sections parents intentionally left blank.

    PARENTS STAND UP. CHILD DENIED ACCESS TO SCHOOL OVER AN ILLEGAL FORM.

    Issues surrounding the IDHW immunization form escalated. Sara’s son was denied access to an Idaho kindergarten after she submitted her own signed statement to the school, along with her child’s enrollment package, a month prior to the start date. Just days before school began, she was told her child was denied entry because she used her own signed statement, despite it being in full compliance with Idaho statute, rather than submit the IDHW form. This drew a LOT of media attention to the problem. It went up the chain of command and, rightfully, Sara’s son’s enrollment denial was overturned by the Superintendent of Education.

    GOV’T ATTEMPT TO MAKE THE FORM MORE PLEASING.

    The IDHW immunization exemption form was problematic from the beginning. Senator Anton called out the form’s most significant issues at the SB 1050 Health Committee hearing. The original form from IDHW attempted to coerce parents to ‘admit’ to putting their children at risk by choosing not to vaccinate. It also demanded parents provide the state with their religious convictions for rejecting vaccinations. Throughout the years, the form has been redesigned and presented to the legislators and rule committees, but each draft continued to contain components not required by Idaho statute. 

    In a goodwill attempt, Sara was invited to a meeting to voice her opinion of the most recent ‘revamp’ on the IDHW immunization exemption form. Sara made a point to advise the committee that the form, in itself, is a non-requirement according to the Idaho statute.

    “The state–prescribed form, based on IDAPA 16.02.15,  is in violation of code 39–4802 and 39–4804. The form developed by IDHW still falls far outside the scope of Idaho code 39–1118(2) and 39-4802(2).”

    Now, you may ask, “Have you seen the new form? They have taken the offensive language out of it.”  Idaho Department of Health and Welfare altered the form both in February 2017 and in October 2017. It has changed, yet again, in 2018 with the addition of check boxes to give parents the option to ‘opt-out’ of providing non-required medical information utilized in vaccine tracking. Still, this “new” form implies that parents should provide information which IS NOT required by statute in order to invoke an immunization exemption for school or daycare attendance. 

    Health Freedom Idaho still stands against the form and advises parents to submit their written signed statement for vaccine exemption to schools and daycare. 

    HFI ENCOURAGES PARENTS TO STAND FIRM. SUCCESS!! QUIETLY THE GOVERNMENT APPROVED NEW RULES! 

    Guess what folks! CHANGES HAPPENED!  < See the new administrative rules for schools and daycares 

    This is good news! Now the Department’s rules are in agreement with the LAW. This should not have taken so long and such a large effort to achieve. Idaho’s parents expect the schools and the legislature to be open to the will of the people and clearly and completely follow the law. We should have had a public hearing on this issue long ago. The resistance of the department and the legislative process in regard to the vaccine opt out matter was a perfect example of government being reluctant to follow the law while adopting an attitude of “we know best.” That is not the way things should work under representative government. I am proud to have joined ranks with those standing up for their rights under Idaho law. I was fully prepared to push this issue next legislative session, but thankfully that won’t be necessary.

    The schools and day cares will now be required to follow the “letter of the law” allowing vaccine exemptions to children with a written statement provided it has only these 4 pieces of information. 

    A signed statement that must include: (5-18-18)

    • i. The name of child and the child’s date of birth; and (5-18-18)
    • ii. A statement indicating that the child is exempt from immunization as provided in Section 110 of this rule for religious or other objections; and (5-18-18)
    • iii. The signature of the parent, custodian, or legal guardian (5-18-18)

  • Health Dept Advises Schools to Fill Out Vaccine Exemption Form for Parents Who Refuse

    A closer look at S 1227 the Immunization Exemption Form. The contradictory IDAPA rule confuses the schools into believing that the parental right to an immunization exemption is contingent on Health Department’s acceptance of their completed form. The statute is clear a parent’s right to invoke vaccine exemptions for their children is NOT DEPENDENT on a form provided by the Health Department. The schools however, are being told during training from the Health and Welfare Department that not only is the form required, the schools are encouraged to complete the form on the parents behalf. 

    We need to require that the administrative policy adheres with statute. Regardless of your opinion on the efficacy of vaccines it is unacceptable to allow the department of health to mandate a discriminatory form for school and daycare enrollment that violates the intent of the law, invades privacy and is potentially self incriminating.  

    Idaho statute 39–4802(2) permits a parent/guardian: 

    1.  The right to choose whether to vaccinate their child.

    2.  The right to choose to participate or decline participation in the state registry system (IRIS)

    3.  The right to opt out without explanation of objection.

    AND most importantly – the right to opt out of vaccinations with a single  sentence parental statement without completing a form.  

    It is ludicrous to be handed a statement from anyone else, much less a government department, and told that you have to sign your name to it.  If you hand me a statement that YOU have prepared and told me to sign it I would say “NO, this is not MY signed statement!”  

    Once you sign this document is it now legally binding and it’s not even the actual intended statement of the parent.

    The Health Department’s Immunization form forces families to waive the right to privacy, violate their legally protected right to opt out of the state registry and provide the state an explanation for their reasoning to opt out of vaccines.

    The state–prescribed form, based on IDAPA 16.02.15,  is in violation of code 39–4802 and 39–4804. The form developed by IDHW falls far outside the scope of Idaho code 39–1118(2) and 39-4802(2).

    Now, you might say, “Have you seen the new form? They have taken the offensive language out of it.”  The Dept has changed that form on Feb 2017 and again on Oct 2017.  

    Still this form continues to request extraneous information that is not required by statute in order for a parent to invoke their vaccine exemption. The school administrators are being told by the Health Department to fill out this information even after the parents refused to do so. Allowing the Health Department to continue to supersede the statute with the administrative rule gives them a misplaced authority to change the form, demand additional information, and continue to cause confusion and outright discrimination at enrollment.

    On August 17 2017 Idaho Health and Welfare hosted a training seminar for schools regarding vaccine reporting. This is the Idaho Provider Immunization Education lead by Mezzelle Moore is the Immunization Outreach and Assessment Coordinator for the Idaho Immunization Program.  At the 45 minute mark of the presentation, during the question and answer session, Ms Moore is asked what to do if a parent refuses to fill out the form.

    She says and I quote, “I know that has come up recently in some outlets and here’s the deal with that so IDAPA requires the school to have that form on file. You’ve got a parent doesn’t want to sign that… you can try and fill that out as best you can. It’s really IDAPA that’s requiring that form…so the form should be on file whether or not they don’t want to sign it.” <LINK TO QUOTE: https://youtu.be/c1zdRKj3sYU?t=45m2s >

    The schools already have access to the child’s immunization records through the tracking system IRIS, and if the parent has opted out of IRIS disclosures tell me how the school admin can possibly know which vaccines the child has or has not received.   I am appalled that the school is being encouraged to fill out a form that has my signature on it without my consent.  Do you, the parent, feel this falls in line with the definition of forgery?

    Idaho Code 18-3203 . OFFERING FALSE OR FORGED INSTRUMENT FOR RECORD. Every person who knowingly procures or offers any false or forged instrument to be filed, registered or recorded in any public office within this state, which instrument, if genuine, might be filed, or registered, or recorded under any law of this state, or of the United States, is guilty of a felony.

    Contact the Senators and ask them to please pass SB 1227. It is imperative for the protection of parental authority and also the protection of  children’s health information. #S1227

  • When Schools Lie and Deny Enrollment, It’s ILLEGAL!

    Registration for the School year has begun. The Health Dept’s No Shots – No School Campaign is in full swing. ITS A LIE! Idaho vaccine exemptions available to families for religious, medical and philosophical reasons. DO NOT BE BULLIED!

    Did your school tell you “no shots – no school?” They are lying! In Idaho, it is illegal to deny your child entrance to school based on the vaccination status.
    The LAW makes provision for children’s entrance to school REGARDLESS of immunization / vaccine status.(See Idaho Statute)

    A Boise mom shared with Health Freedom Idaho that when she turned in her kids’ 2017 immunization exemption forms at the school and they made her speak with the school nurse who LECTURED her about how she was putting her children at risk. The mom, though in her legal rights to make health choices on behalf of her children, felt belittled and left the campus in tears. 

    THIS BULLYING IS UNACCEPTABLE.
    THE LAW IS CLEAR.
    Parents make the choice on which shots their children receive. It is NOT up to the schools to lecture, bully or belittle a parent’s health choices for their children. The schools, funded by tax dollars and under the authority of Idaho statute, are required to accept a parental exemption without question or discourse.

    Health Freedom Idaho is committed to protecting YOUR freedom to choose and your children’s access to education. This is a right that is being denied to more and more families. Here is an excerpt from the IDAPA rules published by the Health Department. Its clear that there are only 3 legal requirements to invoke a vaccine exemption; the child’s name and birthday and a simple statement from the parent/guardian statement: I am invoking my child’s right to vaccine/immunization exemptions on religious or other grounds.

    Per the Health Department Director Dick Armstrong, the parents have to supply the school with a list of the exempted vaccines because the school has no other means to know in the event of an outbreak. 
     FALSE!

    The Health Department maintains a database of all children born in Idaho and their immunization status with the system known as IRIS and the schools have access to that information.
     In fact, the IRIS system accessible by health data vendors, the Health Department, Schools and licensed daycares, as well as all doctors and hospitals. Your child’s private medical information is in the system unless you specifically OPT OUT with the Health Department.

     In the event of an outbreak a parent would have to provide proof of immunization for that specific disease or be excluded from school.

    Here is a very recent example from Idaho.
     This is a Feb 17. 2017 Notice from the Coeur d’Alene Public School:
     In the event of two or more confirmed cases in any one building — which classifies as an official outbreak — students who do not have proof of an MMR vaccination, even if they have a signed exemption, will be excluded from the affected school to protect our students and staff.
     Idaho Code 33-512-(7) outlines exclusions related to contagious diseases.
     Exclusions would last 26 days from onset of the last confirmed case.

    **As a parent WHY am I so resistant to having the school have a list of the vaccines I choose to exempt my child from?
    The IRIS tracking system is in place as an OPT OUT system. Meaning they put the information in the system and its my responsibility to make sure I request its removal (each and every time my child visits a provider that gives vaccines.) I can’t access the system to make sure that information is not contained in the central database. Instead I am forced to trust a government agency who has been intimidating and discriminating against people for years with a form that isn’t legal. I feel CERTAIN that my disclosure of this information would find its way into that State IRIS database without my consent and without my knowledge.

    PROBLEM # 2. Acknowledging putting my child at risk…
     Again, the statutes do NOT require parents to provide this type of information.

    Per the Health Department Director Dick Armstrong, parents make the choice to exempt their children of vaccines then they should acknowledge they are putting their children at risk to get the disease.
     FALSE!

    Recent outbreaks prove UNVACCINATED CHILDREN ARE LESS LIKELY TO BECOME INFECTED IN AN OUTBREAK!

    Parents are forced to sign IDHW’s mandatory form that demands parents state that they are putting their children at risk. No parent should be forced to sign a form that is self-incriminatory in order to enroll their child into a daycare program or public school. Parents with moral conviction religious objections to injecting their children with abortion tainted vaccines are forced to claim membership to a specific denomination that rejects vaccination. The Health Department also requires lengthy explanation for religious and philosophical objections.

    The Public Health department is getting away with creating their own rules and children are being denied access to daycare and schools.

    There is A LOT going on behind the scenes to shut down the bill SB 1050.
    (SB 1050 is the HFI sponsored bill that would keep the Health Departments administrative policy in line with the current statute.)
    It appears we are poking a bear (aka the Health Department) that is use to getting its own way! In order to protect liberty, we need a GIANT response. The Health Department is making every attempt to not only shut down our efforts to keep them ‘in line’ with existing statutes. Tell our elected officials they MUST SUPPORT SB 1050.

    Senate Bill #1050
    Clarifies Section 39-4802 (2)Idaho Code that a parent has the legal right to enroll their child(ren) in Idaho schools, while maintaining their privacy, their right to medical confidentiality, and the right to opt out of providing IRIS-type vaccination information. 

    Parents’ rights, privacy, confidentiality, and the right to shield oneself from unjust incrimination are paramount to Idahoans and of utmost importance in maintaining liberty.  This bill will secure those natural rights.

    Idaho has clearly stated in existing laws that parents are legally able to opt out of some/all vaccines for their children when enrolling in daycare or public school.  The Public Health Department has created administrative procedures that intentionally discriminates against a minority group, violates their privacy, and denies their children access to schools when they opt to take their legally allowed vaccine exemption.

    1. IDAHO STATUES CLEARLY STATE: VACCINES ARE NOT MANDATED FOR DAYCARE or SCHOOLS.
    2. IDAHO STATUES CLEARLY STATE: PARENTS MAY SUBMIT A WRITTEN STATEMENT THAT THEY ARE CHOOSING TO EXEMPT THEIR CHILD FROM SOME/ALL VACCINES.

    Department of Health has created a form that violates family’s rights and in turn forces school officials to deny children entrance into schools

    • IDHW’s form was intentionally created to gather data from parents for the purpose of submitting that data to a ‘voluntary’ vaccine tracking database. Removing parental right to privacy and legal option to OPT OUT of the registry.
    • The Health Department refuses to accept a legally acceptable signed parental affidavit. A blatant disregard for Idaho statue. Discriminating against families who choose to invoke their legal option to vaccine exemption.
     
    The Public Health department is getting away creating procedures that contradict the law and children are being denied access to daycare and schools.

    The purpose of this bill is to clarify Section 39-4802 (2)Idaho Code.

    The current language is as follows:

     (2) Any minor child whose parent or guardian has submitted assigned statement to school officials stating their objections on religious or other grounds shall be exempt from the provisions of this chapter.

     Original Intent

    The original intent of this section was that an Idaho parent/ guardian may exercise their right to privacy and medical confidentiality by simply submitting a signed statement to school officials in

    order to invoke their right to exemption regarding the state-prescribed vaccination schedule for school enrollment.

     Rules Created Mandating Unjust Form

    Rules have since been created requiring a state health department form be mandated. The form that was created for this purpose contains unnecessary, possibly incriminating language that is far outside the scope of this section.

     

    Section 39-4804 Idaho Code is being disregarded in the forced use of the current mandatory exemption form. That section states in part:

     

    NOTIFICATION TO PARENT OR GUARDIAN.

     (b) Participation in the immunization registry is voluntary;Because the Idaho IRIS vaccine registry is voluntary, a parent is not requiredto disclose vaccination status to the state.

     Form Forces Parents to Give Up Rights or Child’s Education

    By mandating the current exemption form, which listsindividual vaccines and demands confidential medical information, parents arenot able to exercise their right to privacy and exemption without facingenrollment denial by schools. Clearly this form does not align with theintentions of the current statutes.

     This Bill Will Re-secure Idahoan’s Rights to Privacy, Confidentiality,& Avoidance of Unjust Incrimination

     This bill would modify for clarification Section 39-4802 (2)to read:

     (2) Any minor child whose parent or guardian has submitted asigned statement to school officials stating their objections on religious orother grounds shall be exempt from the provisions of this chapter. The signedstatement may appear in a letter from the parent or guardian and is notrequired to be made on a form furnished by the state board of health andwelfare, a school, or another entity.

     This clarifies that a parent has the right to enroll their child(ren) in Idaho schools, while maintaining their privacy, their right to medical confidentiality, and the right to opt out of providing IRIS-type vaccination information. Parents’ rights, privacy, confidentiality, and the right to shield oneself from unjust incrimination are paramount to Idahoans and of utmost importance in maintaining liberty.  This bill will secure those natural rights.

    It is ILLEGAL for your school to deny entrance to your child because you are exercising your legal right to opt out of vaccinations.

    Contrary to the Health and Welfares website – this School Exemption Form is NOT the only legal means by which a parent can provide their child’s school of a vaccine exemption.
    Idaho Code 39-4802 only requires a signed statement from the parent(s) or legal guardian of the child.

    Unfortunately, Idaho Health and Welfare Immunization Department (IDHW) has made the use of the form mandatory for schools to admit children whose parents have chosen to legally opt out of some or all vaccines for their children. The form developed by IDHW falls far outside the scope of the Idaho Statutes (section 39-1118(2) or 39-4802(2), Idaho Code;). The state prescribed form  based on IDAPA 16.02.15, is in violation of Idaho Code 39-4802 and 39-4804.  

    Currently, parents are forced to sign IDHW’s mandatory form that demands parents state that “vaccine preventable diseases are extremely deadly” and “that it is negligent for willfully denying your son/daughter the life-saving protection that vaccines offer” in order to enroll their children into school.

    These forms are MEANT to not only be intimidating but to catch parents legally off guard.

    The Idaho Statutes make it clear that parents only legal responsibility  is to provide a written statement they are opting out of vaccines for their children and they are aware of the risks/benefits of the recommended vaccine schedule.

    Surveies show that most schools have denied children access to school when parents have submitted the legally acceptable parental statement of vaccine exemption. There are many schools refuse to accept the form if it has been altered in any way.  

    This illegal action on the part of schools (who feel their hands are tied due to Health and Welfare Administrative policy) has caught the attention of Health Freedom Idaho.  While correspondence from the Office of the Attorney General and Legislators have shown that there is in fact a discrepancy in the legal statues and the scope of the form required by IDHW there has been no challenge to change the current administrative procedures to fall back in line with the law.

    • Idaho Statues permit you as an individual or parent have the right to choose whether or not to vaccinate your child.  
    • The statute does not require you to disclose what other grounds your refusal to immunization is. As with any medical decision, the decision to vaccinate or not is a right of the individual or parent.
    • The State of Idaho, your doctor and public health employees cannot force you or your child to be vaccinated.
    • Your child cannot be excluded from a school or public program because you have exercised your right to not vaccinate.
