  • OPT-OUT OF VACCINE TRACKING

    IRIS is Idaho’s Immunization Tracking system. Your family is AUTOMATICALLY ENTERED into the system by authorized health care providers, child care providers, and schools. Is this a gross violation of privacy?

    Your children’s medical information is likely in the government’s database RIGHT NOW! You must OPT OUT to have your information removed from the IRIS database.

    Once your information is shared within the government tracking database, authorized 3rd parties can take the information and use it as they wish.

    While you can opt out of IRIS and purge your child’s information from their IRIS system, you are unable to purge it from the third-party systems once it has been accessed.

This information is available only to authorized health care providers, child care providers, and schools. Participation in IRIS is voluntary, and you may opt-out at any time by contacting the Idaho Immunization Program at (208)334-5931 and requesting an opt-out form or by completing this online opt-out form. 

    Two options are available for opting out of IRIS for yourself, your minor child (under the age of 18 years), or a person for whom you are a legal guardian:  

    • Option 1:  Remove only immunization-related information from IRIS. Only demographic information is retained in IRIS, including name, address, phone number, mother’s maiden name, date of birth, and gender. Demographic information will not be viewable by medical providers, schools or childcare staff. By making this selection, I understand that allowing demographic information to be retained in IRIS will reduce the chance of accidental or intentional re-entry of vaccination information about me/him/her.
    • Option 2: Remove all information from IRIS – immunization and demographic. By making this selection, I understand that at any time, information regarding myself, my child, or person for whom I am a legal guardian, may be re-entered by a health care provider. I understand that I must work with my health care provider(s) to ensure this information is not re-entered into IRIS.

  • H491 Protection from Mandates and Security of Medical Privacy

    H0491 This legislation establishes provisions regarding mandates and use of force with any vaccination, immunization, genetic modulation, or inoculation of any person. Further, this legislation adds a new section regarding medical privacy and confidentiality, and that medical information cannot be used in employment except for the purposes of drug testing. – This bill is sponsored by Tammy Nichols.

  • A Browser Without Tracking, Surveillance, or Censorship

    Thanks to an assist from Congress, your cable company has the legal right to sell your web-browsing data without your consent. This is how to protect your data from preying eyes. As the battle heats up for health freedom and body autonomy people are more aware than ever before of the sort of information they can reveal every time they set a digital footprint on the web.

    If you want to push back against online tracking, you’ve got several options to pick from when choosing a default browser. These are the browsers that put user privacy high on the list of their priorities. 

    DuckDuckGo (Android, iOS, browser extension)

    You might know DuckDuckGo as the anti-Google search engine, but it’s also branched out to make its own mobile browsers for Android and iOS. Not only do they keep you better protected online, they give you plenty of information about what they’re blocking.

    DuckDuckGo starts by enforcing encrypted HTTPS connections, when websites offer them, and then gives each page you visit a grade based on how aggressively it’s trying to mine your data.

    Ghostery (Android, iOS, browser extension)

    Get Ghostery for Android or iOS installed, and straight away it gets to work blocking adverts and tracking cookies that will attempt to keep tabs on what you’re up to on the web.

    Like DuckDuckGo’s mobile apps, the Ghostery browser tells you exactly which trackers it’s blocking, and how many monitoring tools each website has installed—if you find certain sites that are well-behaved, you can mark them as trusted with a tap.

    Or, if you find a site that’s packed full of tracking technology, you can block every single bit of cookie technology on it (for commenting systems, media players and so on), even if the site might break as a result.

    Ghostery also develops an extension that works with just about every desktop browser out there—again, you can view the trackers on each site you visit, then take appropriate action on them or let Ghostery decide and its AI smarts decide what needs blocking.

    Ghostery’s tools are a little more in-depth and advanced than the ones offered by DuckDuckGo, so you might consider it if you want to take extra

    control over which trackers are blocked on which sites.

    Tor Browser (Android, Windows, macOS)

    Tor Browser stands for browsing “without tracking, surveillance, or censorship” and is worth a look if you want the ultimate in anonymized, tracker-free browsing—unless you’re on iOS, where it isn’t yet available.

    The browser app for Android, Windows and macOS is actually part of a bigger project to keep internet browsing anonymous. The Tor Project routes your web navigation through a complex, encrypted network of relays managed by its community, making it much harder for anyone else to work out where you’re going on the web.

    As well as this additional layer of anonymity, Tor Browser is super-strict on the sort of background scripts and tracking technologies sites are allowed to run. It also blocks fingerprinting, a method where advertisers attempt to recognize the unique characteristics of your device across multiple sites, even if they can’t tell exactly who you are.

    At the end of each browsing session, everything gets wiped, including cookies left behind by sites and the browsing history inside the Tor Browser app itself. In other words, private browsing mode is the default.

    Because of the extra encryption and anonymity measures, Tor Browser can run slightly slower than other browsers, but in terms of staying invisible on the web, it’s the best there is. It can even help you get online in countries where the internet is blocked or censored.

    Brave (Android, iOS, Windows, macOS)

    Brave is a project from Brendan Eich, once of Firefox developer Mozilla, and its mission includes both keeping you from being tracked on the web, and finding a better way to serve you advertisements. It’s a dichotomy that doesn’t fully fit together just yet.

    There’s no doubt about the effectiveness of its tracker blocking technologies though. The browser apps block ads by default and put tight restrictions on the information sites can gather on you through cookies and tracking scripts.

    You can block trackers, scripts, and fingerprinting technologies—where sites attempt to identify your particular device—individually, but unlike DuckDuckGo and Ghostery you don’t get a detailed breakdown of what’s been stopped.

    Brave also tries to block phishing attempts over the web, and will force HTTPS encryption where it’s available. It’s a comprehensive package that strikes a well-judged balance between simplicity and power.

    Time will tell whether Brave’s attempts to create a new privacy-respecting ad platform are successful, but it’s testing the idea of paying users to watch ads and splitting the revenue with content creators. You can also give micropayments to sites you like directly, though all of this is completely opt-in.

  • IRIS OPT OUT

Per a June 9, 2017 phone conversations with the Idaho Health Department, they do NOT have anything in their system that will alert the users of your request to OPT OUT to having your private medical data entered into their system. While you can ask for your information to be removed from the system, it can and will, be entered back in at anytime by authorized users (doctor, schools, daycare). In otherwords, if you don’t submit your request to the schools, doctors, daycare providers that you wish to have your private medical information REMAIN PRIVATE they will assume that you want to be tracked.

  • HIPAA: your medical privacy does not apply

    Protect your Rights!

    MYTH: HIPAA protects your medical privacy

    FACT: HIPAA eliminated patient consent requirements and potentially opens your medical records to 2.2 million entities, plus government agencies.

    MYTH: Signing the form or statement about the clinic’s or hospital’s “Notice of Privacy Practices” (NPP) means your medical information will be kept private.

    FACT: The form regarding the NPP is only an acknowledgement that you have read the form, and therefore understand that you have NO privacy rights, and that your information can be broadly shared without your consent. You are NOT required to sign it (see below). NOTE: whether you sign the form/statement or not signing does not protect your privacy. If you read the NPP, you’ll understand that your signature acknowledges that you know you have no privacy.

    MYTH: The federal HIPAA law and and its “privacy rule” are the highest laws of the land and have the final say on whether patient data can be shared or must be protected.

    FACT: State medical privacy laws are the highest laws. Your data can be broadly shared under HIPAA unless your state legislature has enacted a real privacy law. HIPAA’s “permissive sharing” law is superceded by most state medical privacy laws.

    FIVE REASONS WHY YOU SHOULD NOT SIGN

    1) Exercise your rights under the law not to sign the “HIPAA privacy form” or the Notice of Privacy Practices acknowledgement statement on many clinic and hospital consent forms.

    2) Refuse to participate in perpetuating the deception that the HIPAA form or the Notice of Privacy Practices statement protects your privacy.

    3) Enlighten the clinic and hospital staff on the truth about HIPAA and your right not to sign.

    4) Prevent the clinic from waving the signed form under your nose and claiming that you should have known when you complain after learning they shared your confidential data without your consent.

    5) You will help CCHF move the nation toward the truth about HIPAA and its eventual repeal (and restoration of patient consent, personal control, and ownership rights to one’s own medical and genetic data)

    The 1st WIN FOR HFI! HB 91 IRIS EXPANSION VOTED DOWN

    Idaho HB 91 was designed to further expand the Idaho immunization tracking system. The greatest concerns of IRIS is the lack of privacy, security and the inability of parents to confirm their child’s private medical information is expunged when a family choose to OPT OUT. This system is in place to record vaccinations /immunizations (or lack thereof) of children. As Representative Packer said, the State doesn’t feel parents are responsible enough to keep accurate records. Your child’s medical information is automatically entered into a system accessible by health department vendors, health officials, doctors, schools and registered daycare. HB 91 would expand the data tracking with the mandated inclusion of adults.

    CONCERNS OVER THE OPT OUT SYSTEM: 
    Citizens are unable to OPT OUT of this central database until AFTER the child’s private medical information is uploaded into the central database. The Health Department processes the written OPT – OUT request allowing the department several weeks to do so. This request must be made each and every time a person visits a medical facility that has the capability of administering vaccinations.

    HOW IS THAT LEGAL?

    Idaho’s Health & Welfare Department created a mandatory immunization form that falls FAR OUTSIDE THE SCOPE OF CURRENT STATUTES and is discriminatory to the minority of parents who legally choose to OPT OUT of the full CDC vaccine schedule.

    Parents are forced to sign IDHW’s mandatory form that demands parents state that they are putting their children at risk. No parent should be forced to sign a form that is self-incriminatory in order to enroll their child into a daycare program or public school. Parents with moral conviction religious objections to injecting their children with abortion tainted vaccines are forced to claim membership to a specific denomination that rejects vaccination. The Health Department also requires lengthy explanation for religious and philosophical objections.

    The Public Health department is getting away with creating their own rules and children are being denied access to daycare and schools. 

    Regardless of your opinion on the efficacy of vaccines, it is unacceptable to allow the Department of Health to mandate a discriminatory form for school enrollment that violates privacy and is potentially self-incriminating.

    HB 91 will expand an system ALREADY in place that denies a child’s right to privacy, exposes children’s private medical information to State and third parties and violates HIPPA. Now they wish to expand the tracking of private medical information to adults. This system will mandate that adult’s private/personal medical information entered into the State tracking system within 28 days of a doctor’s visit. It is only AFTER your information is uploaded to the system that you have the opportunity to opt-out.  Once that PHI (private health information) is sent out, there is no expunging it from anyone’s record EXCEPT IDHW, meaning your medical information is now out in the open, with no chance of it being private again, and all without your consent.Once you opt out, the burden is on you to ensure that H&W has actually expunged that info (and remember, other 3rd parties do not have to). This is not just any time you go to the doctor for vaccinations. This is every single time you go to a pharmacist, an ER, an urgent care, to get a mammogram, etc. It is hospital policy to ask patients about vaccination status every time they go in, and there is pressure to give you a flu shot and a DTaP/TDaP booster every time you go in for any kind of injury, especially when you don’t remember when you last received them, even if you are sick (many hospitals even require pressure to be put on those who have immune disorders). 

    This is wrong, and dangerous. “Intent” of the law doesn’t matter so much as the possibility for the law to be misused against the people. Not to mention the inherent violations of privacy written into this particular one.

    HISTORY:

    -IRIS was originally created to allow parents a centralized place to “store” their children’s vaccination records in case they lost their hard copies, and it would be easily accessible to parents, other legal guardians, child care providers, and health care workers if the parents allowed them access to it.

    -IRIS was also an opt-in program originally, so when a parent went in for a well child check, they could sign a waiver (along with the HIPAA form) that allowed their doctor to put their child’s vaccination information into IRIS (because it is private health information, protected by HIPAA).

    -In 2012, IRIS became an opt-out program because doctors complained that the one extra page of paperwork was “too much work”. Now most parents don’t even know their children’s PHI is in IRIS. They can technically opt out by submitting a written statement to IDHW, but it doesn’t function that seemlessly.

    -In 2015, provisions were made to allow 3rd parties access to our children’s vaccination records by omitting the section that previously required records to be expunged from 3rd parties as well when parents opted out of IRIS.

    DANGERS:

    • Because it is an opt-out program, the majority of parents do not know their children’s information is in IRIS. IDHW sends out a paper shortly after your child is born saying that they are enrolled into IRIS, but you receive that about a month after they are born and in the mix of all the other paperwork you get at the hospital or from 3rd parties after a child is born, it doesn’t stick out as anything important unless you already know what you’re looking at.
    • If H91 goes through, your personal medical records will be on file with IDHW until you opt out (and DHW states that it may take up to 2 weeks for you to opt out officially and your records be expunged from H&W)
      .
    • Your information will be given to third parties that DO NOT have to expunge your information, nor do these 3rd parties have to disclose to you that they HAVE your medical information (now, there are 3rd parties, but they are named in the current statute, whereas 2 years ago they were not in the original bill).
    • You cannot just “opt out” of the program before you are entered into it. What H91 does is take it a step further MANDATING that all providers put that medical information into IRIS. Only afterwards can you “opt” out. Providers have a 28-day window to provide IRIS with this information, and IDHW has a 2 week window to expunge your information IF they have your information by the time your provider sends it over. Within the time frame that your provider sends the information to IRIS and the time that H&W expunges that information, H&W will be sending that PHI to 3rd parties without one’s consent and usually, without their knowledge. Once that PHI is sent out, there is no expunging it from anyone’s record EXCEPT IDHW, meaning your medical information is now out in the open, with no chance of it being private again, and all without your consent.

    Particularly since this is done without one’s consent, or even knowledge, it is a violation of HIPAA.     Do you know what IRIS is?

    It is a sneaky invasion of privacy regarding one’s private health information (PHI). IRIS has historically been an immunization registry for children’s vaccination records, but is now being used to assimilate the medical information regarding one’s vaccinations (or lack thereof) without the knowledge or consent of a patient or their guardians. Our children’s vaccination records are already in IRIS, and IRIS is expanding to all adults in the State of Idaho as well.

    That’s right! The Legislature wants to expand their data tracking information to include all adults with HB 91. The newest invasion of privacy has passed committee and will be heard on the house floor Feb 21st. If passed it will move onto the Senate Health Committee and Senate Floor. Time is limited we MUST TELL LEGISLATORS TO OPPOSE HB 91 the bill that will require the State tracking of the  immunizations of all adults.

    Talking Points:

    1) No other pharmaceutical product use is reported to the state like this and this is a violation of medical privacy.

    2)  CDC has openly stated that vaccine registries are a tool to identify areas of “undervaccination” so that they can be “addressed” and brought into “compliance.”   https://www.cdc.gov/mmwr/preview/mmwrhtml/mm6133a2.htm  The healthcare choices Idahoans make are Idahoans’ and there is no need for our choices to be “addressed” or brought into “compliance”. This is an attack on our health freedoms disguised as just a little information gathering. Given that the pharmaceutical companies have nearly 300 vaccines in development and would like to see those used by the entire populace, it is not hard to see why CDC wants to monitor the public’s use of vaccines so it can “address areas of undervaccination.”

    3) We know from the problems many parents have reported that many parents have no idea that IRIS (the Idaho Immunization Registry) even exists, no idea that their children’s information is being entered into the system, no idea that the registry is voluntary and that they may opt out completely yet Idaho Code 39-4803 explicitly states that the registry is voluntary.     4) Given violations of I.C. 39-4803 pertaining to IRIS and children, we are very concerned that adults will not be aware there is a system, that the system is opt out, and that their private medical information will be entered into it. If they aren’t aware the system even exists or that it is voluntary, how is the system truly voluntary? If parents are not being informed of the existence and voluntary nature of IRIS, why should we trust that this information will be explained to adults?

    5) There is nothing in HB 91 that explicitly requires those who administer vaccines to notify vaccine recipients of the existence of IRIS or the fact that IRIS is voluntary but that vaccine recipients must opt out. 

    6) There is nothing in HB 91 that ensures vaccine administrators follow the law. Who will check and ensure the law is followed?

    7) We already know that the Idaho Department of Health and Welfare has violated code with respect to IRIS. Several years ago when Dr. Christine Hahn of the Department of Health and Welfare testified in front of the Senate Health and Welfare Committee, she stated that IRIS had already entered the personal private information of Idaho adults who had received a flu vaccine into the system. This is illegal. There is no code that allows for the private medical information of adults to be entered into IRIS. If they’ve already broken the law, why should we trust that they will follow it now?
